Did you know last week was a big week for #AI with direct impact on #digitalhealth and #womenshealth? A bipartisan group of senators, led by Majority Leader Chuck Schumer (D-NY) unveiled a "roadmap" for lawmakers aimed at guiding Congress on regulating artificial intelligence. The working group behind this measure includes Senators Chuck Schumer, Todd Young (R-IN), Mike Rounds (R-SD) and Martin Heinrich (D-NM). Meanwhile CA and CO are taking the lead among a handful of states in regulating #AI -- last week a CA key committee approved unprecedented legislation while on May 17 CO Governor Jared Polis signed into law similar measures. What does this mean for #digitalhealth and #womenshealth? In CA, S.B. 1047 passed the Senate Budget Committee and would place first-in-the-nation public safety safeguards around how AI companies develop their models to prevent cybercrime. Companies would have to take steps to implement protections and submit documentation to the state. The $16 million measure would establish a public platform for academia and smaller businesses to access AI technology. It is championed by State Senator and Chair of the Budget Committee, Scott Wiener (D). The Committee also passed A.B. 2930, which would ban discrimination from AI tools in hiring, housing, education, and other categories but language allowing lawsuits was removed to secure passage. The $12 million measure by State Assemblymember and Chair of the Privacy Committee, Rebecca Bauer-Kahan (D) has sparked copycat bills in other states. The Committee also approved legislation that would outlaw AI-generated sexual abuse material or revenge pornography: S.B. 926 by Aisha Wahab, MBA (D) and A.B. 1831 by Marc Berman (D). All bills head toward floor votes in the coming weeks. In CO the legislature passed a comprehensive AI package that sets new parameters for "high risk AI" (AI involved in making consequential decision-making) and imposes a duty on developers and deployers to avoid algorithmic discrimination -- and for the first time, does not require intentional discrimination. The package includes increased reporting to enable consumer understanding of how AI is used. While Governor Polis signed it, he warned about unintended consequences blocking innovation as patchwork approach to AI oversight is implemented across the country. What does this mean for #digitalhealth innovators, entrepreneurs, #hightech industry and #patients? Congress will take time to finalize any legislation, unlikely before election day, the CO law does not go into effect until 2026 and the CA bills still need to become law, so there is time to assess and plan for these changes. 🚨 𝗖𝗛𝗔𝗥𝗚𝗘 𝗜𝗻𝘀𝗶𝗴𝗵𝘁𝘀 𝗼𝗻 𝗣𝗮𝗿𝗮𝗴𝗼𝗻 𝗛𝗲𝗮𝗹𝘁𝗵 𝗜𝗻𝘀𝘁𝗶𝘁𝘂𝘁𝗲'𝘀 𝗥𝗼𝗮𝗱𝗺𝗮𝗽 𝗳𝗼𝗿 𝗛𝗲𝗮𝗹𝘁𝗵𝗰𝗮𝗿𝗲 𝗔𝗜 🚨 A recent report by Paragon Health Institute, featured in Fierce Healthcare, outlines a roadmap for the incoming administration's approach to healthcare AI policy. Kev Coleman’s recommendations, particularly around allowing AI solutions to operate without a human in the loop to save costs and promoting competition through AI-enabled devices, are bold and thought-provoking. These ideas bring up several important themes for the future of regulation: 1️⃣ 𝗘𝗻𝗳𝗼𝗿𝗰𝗶𝗻𝗴 𝗘𝘅𝗶𝘀𝘁𝗶𝗻𝗴 𝗥𝗲𝗴𝘂𝗹𝗮𝘁𝗶𝗼𝗻𝘀: Coleman advocates leveraging existing rules for AI safety, fairness, and privacy, avoiding redundant or duplicative laws. This pragmatic approach mirrors insights from a recent paper by Lee Fleisher and Nicoleta Economou in JAMA Health Forum, which explored the possibility of Centers for Medicare & Medicaid Services regulating AI through established patient safety procedures. 2️⃣ 𝗚𝗿𝗮𝗻𝘂𝗹𝗮𝗿 𝗥𝗲𝗴𝘂𝗹𝗮𝘁𝗶𝗼𝗻: AI is not a monolithic technology. Coleman highlights the importance of regulating specific AI types, such as large language models and computer vision, differently, ensuring precise definitions to avoid unintended consequences or unenforceable policies. 3️⃣ 𝗔𝗜 𝗔𝘂𝘁𝗼𝗻𝗼𝗺𝘆 𝗶𝗻 𝗟𝗼𝘄-𝗥𝗶𝘀𝗸 𝗨𝘀𝗲 𝗖𝗮𝘀𝗲𝘀: Granting AI more autonomy in low-risk areas holds potential for productivity gains and cost savings. However, maintaining trust and safety requires continuous, localized monitoring to ensure these systems remain accurate and non-inferior to human alternatives.
