❗❗❗ SBA 504 REFINANCE UPDATE❗❗❗ On November 15, 2024, the SBA enhanced its 504 Debt Refinance Program, offering significant benefits to small and mid-size businesses looking to refinance existing debt. These updates aim to simplify the process, expand eligibility, and provide more flexibility: Here's a summarized version of the updates and changes to the SBA 504 refinance program as outlined in SBA Procedural Notice 5000-857295 and related documentation: 1️⃣ 𝗜𝗻𝗰𝗿𝗲𝗮𝘀𝗲𝗱 𝗟𝗼𝗮𝗻-𝘁𝗼-𝗩𝗮𝗹𝘂𝗲 (𝗟𝗧𝗩) 𝗳𝗼𝗿 𝗥𝗲𝗳𝗶𝗻𝗮𝗻𝗰𝗶𝗻𝗴 𝘄𝗶𝘁𝗵𝗼𝘂𝘁 𝗘𝘅𝗽𝗮𝗻𝘀𝗶𝗼𝗻: The LTV requirement is now raised to 90% for refinancing without expansion that includes other business expenses (EBE). This update also removes the cap on EBEs, expanding financing options for businesses. 2️⃣ 𝗦𝘁𝗮𝗻𝗱𝗮𝗿𝗱𝗶𝘇𝗮𝘁𝗶𝗼𝗻 𝗼𝗳 "𝗦𝘂𝗯𝘀𝘁𝗮𝗻𝘁𝗶𝗮𝗹𝗹𝘆 𝗔𝗹𝗹" 𝗖𝗿𝗶𝘁𝗲𝗿𝗶𝗮: For debt refinancing with expansion, the "substantially all" requirement now matches the 75% standard applied to refinancing without expansion. This shifts from the former 85%/15% split to 75%/25%. 3️⃣ 𝗜𝗻𝗰𝗹𝘂𝘀𝗶𝗼𝗻 𝗼𝗳 “𝗢𝘁𝗵𝗲𝗿 𝗦𝗲𝗰𝘂𝗿𝗲𝗱 𝗗𝗲𝗯𝘁” 𝗮𝘀 𝗘𝗹𝗶𝗴𝗶𝗯𝗹𝗲: Certain secured debts can now qualify as EBEs if incurred before the 504 loan application and secured by the same assets as the qualified debt. This includes debts benefiting the borrower but excludes those for capital expenditures. These debts must have been secured for at least six months, and the borrower must have been current on payments for the same duration. 4️⃣ 𝗥𝗲𝘃𝗶𝘀𝗲𝗱 𝗦𝘂𝗯𝘀𝘁𝗮𝗻𝘁𝗶𝗮𝗹 𝗕𝗲𝗻𝗲𝗳𝗶𝘁 𝗧𝗲𝘀𝘁: The requirement for a substantial benefit now means that new installment payments on refinanced government debt must be lower than the original installment amounts. This revision ensures greater borrower access and flexibility. 5️⃣ 𝗥𝗲𝗺𝗼𝘃𝗮𝗹 𝗼𝗳 𝘁𝗵𝗲 𝟱𝟬% 𝗖𝗮𝗽 𝗼𝗻 𝗥𝗲𝗳𝗶𝗻𝗮𝗻𝗰𝗲 𝘄𝗶𝘁𝗵𝗼𝘂𝘁 𝗘𝘅𝗽𝗮𝗻𝘀𝗶𝗼𝗻: The cap limiting CDCs (Certified Development Companies) to refinancing no more than 50% of their prior year loan approvals has been eliminated. This change aligns with the Economic Aid Act of 2020. No new updates were needed for SOP 50-10-7.1 since this removal was previously incorporated. These changes enhance the program's utility for businesses seeking more favorable refinancing terms.
