As the fight continues over enforcement of the Corporate Transparency Act, businesses would be well-advised to prepare to comply with all reporting requirements by the original January 1 2025 deadline, as the government’s latest emergency motion could mean the Fifth Circuit Court of Appeal narrows or lifts the lower court’s injunction just days before the Act’s reporting deadline. In a new insight, Barbara Smith Tyson, Caitlin Hartsell, Meryl Macklin and Adam Vukovic recount the current timeline for the government’s appeal of a preliminary injunction enjoining enforcement of the Act and what it could mean for businesses. In recent months, the European Commission has been under pressure to postpone the EU Deforestation Regulation (EUDR) by one year. The EUDR is a new piece of legislation that would impose strict conditions on traders looking to sell products made from specific commodities, such as cocoa, coffee and rubber in the EU. Under this legislation, traders would need to prove the products were not drawn from recently deforested land, for example. On December 3, 2024, the European Parliament and Council reached an agreement to delay the EUDR's implementation, in a move that will be welcomed by the traders concerned. In a new insight piece, Constantin Achillas and Roland Montfort take a deeper dive into the EUDR and the precise details of its application.
