We are pleased to mark International Anti-Corruption Day with the release of the results of our International Arbitration Survey 2024: Arbitration and the Challenges of Corruption. Despite international efforts to combat corruption, it continues to affect all countries and to infiltrate all business sectors. Corruption remains one of the biggest challenges facing international commerce and how corruption allegations are dealt with in international commercial and investment arbitration is of particular significance. This year’s survey canvased views on the risks that corruption can pose for arbitration and the integrity of the arbitration process and whether change is needed to avoid arbitration becoming a safe harbor for corruption. We hope that our survey report provides a useful contribution to this important debate for current and future generations of arbitration practitioners. Today I participated in a panel discussion regarding cross border M&A deals along with Vered Ben Jacob, Jonathan Morris & Jonathan Nesher. The event was hosted at the Tel Aviv offices of BCLP. This was a collaboration between the firm and the ACC Israel Public Companies Forum. Our moderators, Yifat Philip and Ori Levanon, did a great job in asking very direct and clear questions and I hope that the audience members enjoyed the discussion and gained valuable insights into this important matter. I mostly spoke about the importance of the relationship between the external and internal legal teams and I gave my usual tip to any inhouse counsel dealing with buy side to focus mostly on commercial due diligence aspects and dive into that as after the merger closes you will be left to deal with these matters. If you are interested in additional tips etc. about handling M&A feel free to reach out directly. One thing I learned today from Ori was the meaning of the concept of TIPS which apparently is an acronym (who knew). It actually is short for To Insure Prompt Service which I thought was pretty interesting. Today my BCLP colleagues Jennifer Hutchens, Frank Miskiel, and I published an article in Law360 on the upcoming Federal Circuit oral argument between Teva and Amneal on Teva's listing of certain patents in the FDA's Orange Book. We focus on the competition-related arguments each side makes in their briefs, as well as the FTC's amicus brief filed in support of Amneal. As discussed in the article, the FTC amicus brief curiously foregoes the FTC's customary expertise or evidence-based analysis.
