A team at Harbottle & Lewis led by partners Sacha Wilson and Emma Wright has contributed the UK chapter for 'AI Regulation Guide', published by WITL (World IT Lawyers). The interplay of AI, data and the role of the human in litigation was brought under the lens at our morning fireside chat yesterday, held in collaboration with Epiq for #LIDW24. Chaired by court reporting expert Lorraine Medcraft and insights from our CRO Peter Nussey and partner Guy Pendell from CMS UK. 🚀 AI rising rapidly in the legal sector! According to a recent blog by LexisNexis, AI implementation is increasing across the UK legal landscape, transforming the way legal professionals operate. According to survey findings, the number of lawyers using generative AI for work purposes has nearly quadrupled in just over a year, jumping from 11% in July 2023 to an impressive 41% in September 2024. Additionally, the percentage of lawyers planning to use AI has also increased significantly, from 28% to 41% during the same period. As firms increasingly adopt AI technologies, they are seeing immediate benefits from streamlining routine, administrative tasks. Therefore, activities such as legal research, document review, and contract analysis will become simpler and quicker, allowing lawyers to concentrate on complex and strategic work. The larger law firms, one being Linklaters, seem to be at the forefront of driving AI adoption, with 78% having made changes to implement generative AI. As with any technological change, this does come with some challenges. It will be important for lawyers to keep up with the pace of the new technology, which will bring the need for continuous learning, resource allocation, and training to stay ahead of the curve. Will AI continue to just be an immediate benefit to help with the administrative tasks in the legal sector, or could it ever be a long-term solution to completely solve complex legal work? 📣 The LegalGeek Conference 2024 took place in the end of last week covering all things legal, including legal innovation, law/legaltech and much more.  🚧 Inevitably, the issue of access to justice featured prominently, including a presentation on the subject by Christina Blacklaws, chair of LawtechUK and former president of the The Law Society. 💷 As interestingly highlighted in this reader’s comment in the Law Society Gazette coverage of Christina’s presentation (link below), in many cases the issue of access to justice (or to legal services more generally) is actually one of affordability. There is certainly no shortage of qualified legal services providers, including alternative and innovative models of delivery of legal services. Should Law Firms Review Billing Methods if They Are Using AI? 🤔 According to a recent LexisNexis UK survey, nearly 40% of private practice lawyers in the U.K. and Ireland said the billable hour model will remain in place, and only 17% think it will be abandoned because of AI, 42% are uncertain about AI's impact on pricing structures. Interestingly, while 40% of lawyers still see the billable hour persisting, around four out of five—82%—of the 803 surveyed legal professionals are currently using or planning to adopt AI tools for work. Meta Blocked from Challenging £2.3 Billion Class Action Approval Yesterday, the Competition Appeal Tribunal (CAT) denied Meta to challenge a class action worth £2.3 billion ($2.8 billion). This case accuses the parent company, Facebook of exploiting UK user's data for profit. Key Insights: -Allegations Against Meta: User data was exploited through the network in exchange for control of their data, including the ability to track what they do on other websites and applications.  - The class action states a 44 million-strong class of U.K. consumers who say that the social media titan exploited their data. -CAT’s Decision: The Competition Appeal Tribunal rejected Meta's case because it relies on an "overly prescriptive approach to United Brands, accompanied by a mischaracterisation of the [claimants'] methodology." The tribunal said Dr Liza Lovdahl Gormsen's case "clearly considers the economic value of the product" and that it certified the case on this basis.
