🚨 Has the child protection system "begun to unravel"? ⚠️Child Law Project highlights system in freefall- 🔗 👉🏻 https://lnkd.in/ePtgG-6D ⚠️'Despair' over lack of beds for most vulnerable children, says Child Law Project 🔗👉🏻 https://lnkd.in/efbsrzTf 📝The latest report from the Child Law Reporting Project has been published and is grim reading: 🚸A number of judges have expressed "despair" over a lack of special care beds for some of the most vulnerable children in the State, according to the Child Law Project. 🚸Many of the latest reports show there are no special care beds available to children who are under a special care order. 🚸A shortage of appropriate care placements - in foster care, residential care and special care - dominate the publication. ⚠️One High Court judge described the situation as "a tsunami about to reach shore and nothing is being done". The Child Law Project has expressed fear that the system "has begun to unravel". Of particular concern are cases where the child was being sexually or criminally exploited and the level of support in their care placement was not sufficient to stabilise them and address these risks. ❗️It has called for urgent action across Government to halt the spiral of "poor practice" and added that trust needed to be built in the care system. ❌As of June 2024, the Child Law Project stopped attending court. 'Judge-led mediation'....ummm ? Why is there a determination to make mediation 'part of' and intertwined with the legal system and thus become incredibly complex and thus ineffective? Why is mediation not left as an alternative, without prejudice process such that clients can choose between one and the other, not have something which is so complex when intertwined with the legal system it cannot but be subject to these kinds of risks. I don't get it. Just leave mediation to be what it is.....an incredibly simple and thus effective and client-led process and leave the legal system to its entirely different, philosophically and practically, process. Trying to mix the two is like stirring up oil and water.

According to the Office for National Statistics; ‘Black women face higher rates of domestic violence and are disproportionately affected compared to other groups’(ONS, 2020) This underscores the importance of targeted support and intervention. 🚨 NEW REPORT: 'The Legal Dragnet - Joint Enterprise Law & Its Implications' by Nisha Waller, Centre for Crime and Justice Studies 🚨    The report highlights a case from Manchester in 2017 that our Keir Monteith KC is appealing to the Criminal Cases Review Commission, where Black and mixed-race teenagers were sentenced to a total of 168 years for one murder under the law of #JointEnterprise. Keir represents Nathanial Williams, Durell Goodall and Reano Walters. 🚨 Almost 100 cases prosecuted under Coco’s Law ⚠️Harrasment and Harmful Communications Act- early signs show it has positive impact: 📝A review by the Department of Justice has shown early positive signs as to the effectiveness of Coco’s Law 🔗 https://lnkd.in/eFSG7Gx2 ❌The Act itself provides for offences relating to the recording, distribution or publication of intimate images and for the anonymity of victims of those offences; and for an offence involving the distribution, publication or sending of threatening or grossly offensive communications. 🚷It addresses the distribution or publication of an intimate image without consent with intent to cause harm to the victim. The Act makes it an offence to threaten to distribute or publish such an image. 📵It also provides for a strict liability offence to engage in the recording, distribution or publication of an intimate image without consent, with no requirement to prove an intention to cause harm. ☎️ The Act also sought to target other areas of harmful communications by creating a new offence of distributing, publishing or sending a grossly offensive communication with the intent to cause harm 👮🏼The review has also shown an increased awareness that sharing intimate images without consent is illegal - following a widespread public campaign See more here:

Tara is a Fellow with the Institute for the Study of Conflict Transformation and a certified transformative mediator. She is the author of The Mediator’s Approach: Five (and a Half) Paths Through Conflict (2021) and co-author of Self-Determination in Mediation: The Art and Science of Mirrors and Lights (2022). This course goes beyond a mere introduction and digs deeper into both the theory and practice of the transformative mediator. It also includes a conversation about how to integrate the transformative approach into your own practice if you’re not yet (or ever!) ready to go “all in.”. It also provides different ways of thinking about the mediator’s role that can help your reflective practice, whichever model you use. Tara also explains how a transformative mediator introduces the process to the parties, approaches one-on-one conversations, and works with lawyers and support people. Tara addresses some of the main misconceptions about transformative mediation, and she answers questions from mediators trained in the facilitative model. The course includes two transformative mediation role plays (conducted by Dan Simon and Samantha Hardy) and comes with a workbook to apply your learning.
