Segunda-feira (26), Luca Schirru, diretor-executivo do Instituto Brasileiro de Direitos Autorais (IBDAutoral), participou do evento “Options for making the EU copyright and data legislative and regulatory framework better fit for research” (Alternativas para tornar o arcabouço regulatório da UE em matérias de direitos de autor e dados (não-pessoais) mais adequado para a pesquisa, em tradução livre). Organizado pela European Commission, o debate discutiu as conclusões de um estudo lançado no contexto da Ação 2 da European Research Area (ERA) Policy Agenda, que avaliou os efeitos do quadro de direitos de autor da UE e os efeitos de potenciais intervenções. Também identificou e apresentou disposições relevantes para a investigação em matéria de dados e legislação digital da UE, com destaque para os direitos e obrigações. Luca Schirru, que também é pesquisador de pós-doutorado no Centro de Direito de TI e Propriedade Intelectual (Centre for IT & IP Law (CiTiP) @KU Leuven ), moderou a conversa “O novo cenário da legislação de dados – Desafios e oportunidades para instituições de pesquisa”, junto de Dra. Citation: (T)OP(TM)/532/2023 The Hon’ble Madras High Court has, in a rectification petition, filed by the petitioner under Sections 47 and 57 of the Trade Marks Act, 1999 (“Act”) to expunge the trade mark SOLIDARE in Class 9 registered in the name of, Salahudeen Abdhullatheef, from the records of the Register of Trade Marks, held that a counter claim cannot be filed in response to such a rectification petition under the Act. The respondent, in response to the rectification petition, filed a counter affidavit and counter claim seeking removal of the petitioner’s trademark, SOLIDAIRE, subject of Registration No. 1574746 in the same class. The petitioner challenged the maintainability of such a counter claim and argued that neither the Act nor the rules framed under the Intellectual Property Division (IPD) Rules of the Madras High Court, 2022, provides for a counterclaim in response to rectification petition. The respondent, on the other hand, argued that the Court has wide powers under Sections 57(3) and 57(4) of the Act to including powers to decide any question that it may be necessary or expedient to decide, in particular, powers to rectify the petitioner’s trademark through a counterclaim. The Court, while, agreeing with the petitioner’s argument that, the Act does not provide for counter claims, treated the counter claim as a fresh and separate petition and directed the learned Registrar of Trade Marks to assign a separate original petition number to the counter claim. "People don't buy what you do; they buy why you do it." Simon Sinek's words resonated deeply with me yesterday as I had the privilege of sharing the Lektou story at the Católica | Faculdade de Direito (Escola de Lisboa)'s event. It wasn't just about showcasing our legal expertise or listing our accomplishments. It was about connecting with you, the aspiring lawyers, on a deeper level, revealing the heart and soul of Lektou Portugal. We discussed our unwavering commitment to excellence, our passion for navigating complex legal challenges, and our dedication to building lasting relationships with our clients. We emphasized the importance of integrity, innovation, and collaboration – the values guiding our decisions and actions. Sharing the stage with a panel of exceptional legal professionals amplified this message. Together, we painted a picture of a workplace where passion meets purpose, individual talents contribute to a shared vision, and continuous learning and growth are encouraged and celebrated. (Of course, we also shared a few laughs and traded stories about our most memorable (and sometimes bewildering) courtroom encounters. Because even purpose-driven lawyers need a good dose of humor.) Later, I joined a panel discussion on "Dispute Resolution - Sports Arbitration." It was a fascinating reminder that legal principles are essential in every field, ensuring fairness, accountability, and a level playing field (pun intended!). And a special thanks to Tânia Pinho, whose exceptional photography captured the essence of our "why" – the passion, dedication, and unwavering belief in the power of the law. Tania, your ability to capture not just images but the very spirit of an event is truly remarkable. A promotion is the least we can do to recognise your extraordinary talent.
