Residents Protest Against the Fraud of 'Marathon Realty' Harassment of Homebuyers – Financial and Mental Abuse Amit Pawar Sprouts Exclusive (read the full news here - https://lnkd.in/dD2T6m4f) The real estate sector is rife with grim stories where common homebuyers invest in residential projects only to discover that the necessary approvals for these projects are not always obtained. This harsh reality was recently highlighted by Ajoy Mehta, a retired administrative officer and former chairman of 'MAHARERA.' One such example has recently come to light involving a 22-story building named 'Marathon Neo Skies' built by Marathon Realty Private Limited in Utkarsh Nagar, Bhandup West. The project is no less than a nightmare for residents, as it has been constructed in violation of legal norms, breaking the promises made to homebuyers at the time of sale. As a result, residents have decided to seek justice from 'MAHARERA.' A Model of Oppression and Mismanagement The residents of 'Marathon Neo Skies' expressed their frustration, calling the building an example of oppression and mismanagement. The developer delayed the handover of possession by 6 to 9 months beyond the agreed timeline stated in the agreement. To cover up their incompetence, the developer forced buyers to sign a "Declaration cum Undertaking" against their will. During a site visit, the project director, Kaivalya Shah, was approached by some residents to discuss the administrative and technical issues they were facing. At the time, Shah promised an amicable resolution. However, despite multiple follow-ups through emails, the matter was ignored. The agreement clearly mentioned that possession would be handed over by December 2023, but under pressure from angry residents, the developer hastily handed over possession in June 2024, even though the construction was incomplete. In accordance with Section 18(1) of the MAHARERA Act and the agreement, the residents demanded compensation from the developer. However, the developer arrogantly denied the claim, stating in writing that no such provision exists under Marathon's rules. Is Kaivalya Shah Above the Law? Residents have raised serious concerns, questioning: · "Are Marathon's rules more important than the MAHARERA regulations?" Shapoorji Pallonji Group consolidates its real estate holdings under SPRE The company aims to unlock value, streamline operations, and monetize its portfolio of land parcels spread over 2,000 acres across key property markets. The assets are estimated to be worth around $6 billion. Shapoorji Pallonji Group has formed a new holding company, Shapoorji Pallonji Real Estate (SPRE), to consolidate its extensive real estate assets across India's key cities. This move aims to unlock value, streamline operations, and prepare for a potential public listing within two years. The consolidated assets include 2,000 acres of land worth around $6 billion (Rs 50,000 crore) and a development potential of 140 million sq ft, with 22 million sq ft currently under development. SPRE's portfolio could generate up to Rs 200,000 crore in revenue after development. The company is focusing on enhancing operational efficiencies and growth opportunities, including expanding its middle-income housing arm, Joyville Shapoorji, which plans to launch five new projects annually. New polling released by the Social Research Foundation (SRF) vindicates research conducted by the Institute of Race Relations (IRR), which emphasises merit over race in job appointments. The IRR notes in a statement that results of SRF polling released this month show that most South Africans, of all races, believe that government appointments should be based on merit, not race. Polling also shows that most South Africans think that businesses should be free to operate without the straitjacket of racial diktats, as long as they pay tax and create employment. Says IRR analyst Marius Roodt: “These findings match the results of IRR polling, which has been conducted regularly over many years. Our polling, going back to the turn of the century, shows that the majority of South Africans are not as race-obsessed as some politicians would have us believe and that we get on pretty well. “These findings also suggest that perhaps it’s time to re-examine policies such as black economic empowerment (BEE), which have done little to lift poor black people out of poverty, and likely have little popular support,” says Roodt. “The government of national unity (GNU) needs to abandon policies which have not worked. With regard to BEE, the GNU should consider the IRR’s Economic Empowerment for the Disadvantaged (EED) proposal, which is a system of empowerment based on actual need rather than on skin colour. This policy would help people on the basis of actual disadvantage, with the vast majority of beneficiaries still being poor black South Africans.” Roodt concludes: “The IRR is about to conduct a new round of polling and it is very likely that the findings will reflect the SRF’s recent findings, as well as confirming the IRR’s previous findings. Race-based policies have simply not worked in this country and they are not popular with the public. The GNU needs to look at other ways of combating poverty.”

I've noticed a new trend emerging in the real estate sector in the Mumbai Metropolitan Region. Matunga, Bandra East, Versova and Chembur are suddenly picking up as luxury micro markets and premium real estate developers are expanding into these new markets. So what does the data say? How are the markets actually doing? ➡ Propequity research indicates that average price per sq.ft. in markets like Chembur have risen from Rs. 25,600/sq.ft. in 2019 to Rs. 31,200/sq.ft in Feb, 2024. This is a 21% rise in 5 years. ➡ Bandra East has seen consistent appreciation in property prices but is still much cheaper than its western counterpart. According to statistics over 50% of properties in Bandra East are priced below 5 crores ➡ Versova is also picking up because of increasing connectivity and sea view. ➡ having said this, the biggest opportunity in Mumbai real estate lies in the redevelopment of old buildings, according to an ambit report. There are 14,800 buildings older than a century which make the central way forward for developers in MMR. ➡ I recently chatted with Boman Rustom Irani of Rustomjee Spaces who told me that they expect 45%-50% of their future sales to be redevelopment projects ➡ Irani also says that this sudden surge in property prices in Chembur is due to infra development and connectivity. He says that these new micro markets are a focus for them. The only concern is that one can get carried away with redevelopment pricing, so it’s advisable to stick to credible and reliable players in the space only. What do you think? Cancelled a flat booking and the property developer forfeited the entire booking amount? Godrej Properties Limited did just that to an individual in 2019. However MahaRERA applying a 2022 circular made this action 'not legal'. According to an official spokesperson from Godrej Properties Limited, "The authority in its detailed order has disregarded the allegations made by the complainant and has ruled in our favour by holding that there is no wrongdoing on part of the Developer, yet authority directed us to refund the amounts to complainant after forfeiture of amount equivalent to 2% of the sale consideration." According to Heena Chheda "It is pertinent to note here that under the Model Agreement for Sale as prescribed by MahaRERA, there is no clause categorically providing for the consequence when a buyer wishes to cancel the booking. The Central Government's model RERA Act is silent on the aspect of the process to be followed in the event an buyer cancels the booking and seeks refund of the booking amount." According to Shweta Bharti "In the case of CCE V Mysore Electricals Industries Ltd. Appeal (civil) 4488 of 2005, the Hon’ble Supreme Court had categorically held that a beneficial circular has to be applied retrospectively while an oppressive circular has to be applied prospectively.
