[#RDUE] Le saviez-vous ? Etape cruciale pour la préparation de l'application de la loi, la COMMISSION EUROPEENNE a lancé le système d'information pour l'EUDR le 4 décembre dernier. C'est à travers ce système que les déclarations de diligence raisonnable (DDS) devront être soumises, afin de démontrer que les produits ne sont pas associés à la déforestation ou à la dégradation des forêts. Ces déclarations, soumises sur le serveur LIVE, ont une valeur légale et peuvent être contrôlées par les autorités compétentes des États membres. 💡 Bon à savoir : un serveur test permet aux opérateurs et metteurs sur le marché de s’exercer dès aujourd'hui sans valeur juridique ! 👉 Notre plateforme de traçabilité est déjà parfaitement interconnectée avec le système d'information de l'UE, et permet une automatisation complète du reporting pour tous les modes opérateurs (importation, échanges commerciaux, mise sur le marché, exportation). 🌳 Affichage du coût environnemental textile : zoom sur le décret final La semaine dernière, Agnès Pannier-Runacher a dévoilé le projet de décret final sur le "coût environnemental" des produits textiles. Ce projet est pour l'instant soumis à une consultation publique ouverte à tous jusqu'au 19 décembre, de la même manière qu'un projet d'arrêté. Ce coût, exprimé en points d’impact, doit illustrer l’impact environnemental global d’un produit (fabrication, matières premières, transport, etc.). L’objectif ? Aider les consommateurs à faire des choix plus éclairés. 📅 Janvier 2025 : Notification du décret à la Commission Européenne (validation sous 3 mois). 📅 Avril 2025 - Avril 2026 : Phase de test. Les marques pourront calculer et déclarer leurs coûts environnementaux via le portail public, mais aucune tierce partie ne pourra publier ces scores sans leur accord. ⚠️ À partir d’avril 2026 : Déploiement global. Si une marque ne publie pas son coût environnemental, d’autres acteurs (associations, applications, etc.) pourront le calculer et le déposer. Quelles obligations pour les marques ? - Les résultats doivent obligatoirement être calculés via la méthodologie et le portail Ecobalyse. - Si une marque utilise un autre score (ex. EUDR, CSDDD, UFLPA, US FSMA, DPP, LkSG, New York Fashion Act, Chinese SEDM... There is clearly a global wave of value chain related regulations, a wave that some may qualify as a tsunami. Whether this is overwhelming, threatening business and trade, or impairing liberties, is an interesting theoretical debate. Yet this debate is a bit disconnected from the harsh reality. First because the reality of value chains in terms of environmental impact, slavery, child labor, frauds or counterfeiting is shocking and increasing : this is the phenomenon that really impairs business and liberties. Second because the worldwide emergence of such regulations illustrates that the likelihood of them all disappearing is close to zero. This wave of global regulations defines a new "license to operate". In other words it's important to understand what is at stake as much as what is required, to be able to adopt a comprehensive approach to compliance. That comprehensive approach is our job at Tilkal : if some of the largest and most demanding companies in Europe trust us to be their #traceability and #compliance backbone, I dare say it illustrates that we deliver up to their standards. Yet, we lacked sharing. We lacked a shareable formalization of our regulatory intelligence in relation with value chains. We started to solve that a year ago, by releasing a handbook covering 10 key regulations, followed by a toolkit dedicated to #EUDR. We got excellent feedbacks, so we continued: today I am extremely proud of the Tilkal team for releasing the second version of the Regulatory Handbook, covering a total 15 key regulations worldwide. It is a dense and practical document, with no bullshit, no hidden marketing, just a concentrate of hard work. Actually there's more (spoiler alert)... 🚨 [#PolicyWatch] A breakthrough was reached yesterday on EUDR, with a trilogue agreement between the European Council, Commission, and Parliament. Despite recent twists in the legislative process, the outcome has returned to its original position. 🔎 What does this mean? - Application delay: The EUDR will now take effect on 30 December 2025, a 12-month extension. This delay ensures legal certainty, predictability, and ample time for smooth implementation, including the establishment of comprehensive due diligence systems covering all relevant commodities and products. - No substantive changes: The "no risk" category has been removed, and all other rules remain intact. 📅 Next steps: The provisional agreement must now be formally endorsed by the Council and the Parliament. Once adopted and published in the Official Journal, it should enter into force before the current regulation's application date of 30 December 2024. [#PolicyWatch] On November 19, 2024, the EU approved the Forced Labor Regulation (FLR), banning the sale of products made with forced labor within the EU market, including online sales. This regulation applies to all products, sectors, and companies—both inside and outside the EU—covering every stage of the supply chain. It will come into force in three years. The European Commission will provide further guidance in the coming months, outlining the information companies will need to submit during investigations. However, compliance will require companies to establish robust due diligence practices across the value chain, adopt transparent policies, and ensure auditable traceability throughout their supply chains, as competent authorities will rely on traceability data to assess the likelihood of violations and to conduct investigations.
