Just published: In their new Policy Paper, Lukas Seiling, Jakob Ohme, and Ulrike Klinger (DSA 40 Data Access Collaboratory) provide feedback on the Delegated Regulation on Data Access outlined in the EU's Digital Services Act. The paper focuses on the steps in the data access procedure and the design of the data access portal, and on the types of data, documentation, and modalities of data access. 3 members of our core team, Lukas Seiling, Ulrike Klinger and Jakob Ohme, are discussing the draft delegated act on #DSA40 non-public data access in a recent text for Tech Policy Press. It includes a summary of the draft and the highlights central points welcomed by the scientific community. However, they also argue that the current text falls short in providing a solid foundation for the risk governance framework set out by the DSA as it suffers from a limited conception of empirical research while not ensuring reliability & accessibility of non-public data access. One step closer to the new era of transparency and accountability to the tech industry. This week, the providers of the first 19 very large online platforms (VLOPs) and search engines (VLOSEs) must publish for the first time their annual risk assessment and audit reports under the Digital Services Act. Designated in April 2023, these online platforms and search engines have to identify, analyse and mitigate a wide array of systemic risks ranging from how illegal content and disinformation may be amplified on their services, to the impact on the freedom of expression and media freedom. In their annual risk assessment and audit reports, the VLOPs and VLOSEs need to also assess and outline the measures they have put in place to mitigate the identified risks. A lot of things happened in the last two weeks, but as a researcher something you SHOULD care about is the publication of the draft delegated act on data access (Article 40) under the EU Digital Services Act. Why? Article 40 mandates that certain online platforms provide data access specifically for research contributing to the detection, identification, and understanding of systemic risks within the EU.
