Asia Justice Coalition's thirteenth publication in our series of primers on international accountability in #Asia addresses 'Gender and International Criminal Law.' This primer offers a concise explanation of the following: 1) why 'gender' is relevant in international criminal law; 2) how existing international criminal law explicitly address ‘gender-based crimes’; 3) whether existing international crimes include forced marriage; 4) whether existing international crimes include human trafficking for sexual exploitation; and 5) what '#genderapartheid' is. Read the full primer here: https://bit.ly/GenderICL We would like to thank Mariam Hiba Malik for her work on the primer. Today at the 10th session of the UN Intergovernmental Working Group on TNCs and other Business Enterprises with respect to Human Rights, I shared ICJ’s comments and proposals on the issue of access to remedy for victims and affected persons and communities in the context of business activities, with a view to improve the current draft of the future treaty under negotiation (article 7). As this year marks 10 years of negotiation, it is positive to see that States are actively engaging in discussing concrete textual proposals about the various aspects that the future treaty should cover.

#EU #InternationalMigrationsDay: The ICJ calls for a ban on #child immigration #detention by EU Member States under the #EUPact “The EU Pact should not become an excuse for EU Member States to detain #migrants, including children and other vulnerable individuals,” said Karolína Babická, PhD., ICJ Europe and Central Asia Programme’s Senior Legal Adviser. “On the contrary, we call on Member States to ensure they honour their obligations under international human rights law and safeguards imposed by EU law”. #Tunisia: Today on #InternationalMigrantsDay, the International Commission of Jurists published "The Price of Complicity", a new briefing on the serious violations of the rights of #migrants, #refugees, and #asylumseekers in Tunisia, including following the 2023 EU-Tunisia Partnership Agreement. The #EU's partnership with Tunisia prioritizes the control of migration over #humanrights, and aims to externalize the EU's obligations towards refugees, asylum-seekers and migrants. It’s time for the EU and Tunisia to guarantee refugees, asylum seekers and migrants’ rights to #life, to #freedom from #torture or other cruel, inhuman or degrading treatment or punishment, to liberty and security of person, and to legal protection. Collective expulsions of refugees and asylum-seekers and racial #discrimination against them must end. Read more about the ICJ’s recommendations to both Tunisia and the EU to safeguard the rights of refugees, asylum-seeker and migrants 👇🏼

ECOWAS Commission adopts statute of “hybrid” court to prosecute crimes under ex-president Yahya Jammeh The agreement on 15 December 2024 to establish a special court to try the worst crimes committed under the rule of the former president of #Gambia, Yahya Jammeh, if swiftly implemented, could mark a turning point in the campaign to bring Jammeh and his accomplices to justice. “After the powerful public testimonies at the truth commission, which deeply impacted Gambians, there is strong expectation in Gambia and internationally that there will be justice,” said Reed Brody of the International Commission of Jurists, who has worked with the victims and the Gambian authorities on plans for the court. “It will be hard for Equatorial Guinea to refuse to turn over Yahya Jammeh to a court that represents the entire West African region.” To the story👇 https://lnkd.in/e3wqVAQC

The ICJ, jointly with the Due Process of Law Foundation (DPLF) and the Latin American Federation of Magistrates, launched the report "Neither comprehensive judicial elections nor judicial reform in #Bolivia", assessing the shortcomings of the recent pre-selection procedure for the election of higher judicial authorities and other challenges to the independence of the judiciary. “As our report demonstrates, the present system does not contain the requirements for a competent, #independent and impartial #judiciary under the rule of law and is in urgent need of reform in order to guarantee the procedure meets international standards for independence of the judiciary”, said Carolina Villadiego Burbano, ICJ Latin America Team Leader.
