The European Commission has published its guidelines on the interpretation of the refuelling obligations for aircraft operators (“Refuelling Guidelines”). EU Regulation 2023/2405 (“RFEUA”) specifies the rules on ensuring a level playing field for sustainable air transport. Article 5 RFEUA imposes obligations on aircraft operators with regard to refuelling, to address the practice of fuel tankering. The Refuelling Guidelines provide additional information about the interpretation of Article 5 RFEUA and on the application of the exemptions it provides for. An aircraft operator will be able to derogate from the refuelling requirement: • if, for safety reasons, an aircraft must be refuelled at the airport of departure; • if there is a serious and recurrent operational difficulty that has led to unreasonable turnaround times; • If there are structural fuel supply difficulties arising from geographic considerations; Providing the necessary documentation and justifications to prove the above criteria imposes a heavy administrative burden on affected aircraft operators. The Court of Justice of the European Union (CJEU) has handed down a crucial ruling concerning the discriminatory taxation of dividends received by non-resident insurers in the Netherlands, which could have significant implications for non-resident insurers in Belgium. While previously the burden of withholding tax in the Netherlands was neutralised for resident insurers only, the CJEU ruled that this difference in treatment constituted an unjustified restriction on the free movement of capital. The CJEU's decision paves the way for recourse by non-resident insurers that have invested in Belgian companies and suffered unjustified withholding tax on dividends. They could now seek repayment of the withholding taxes unduly withheld. The claim for repayment of the withholding tax overpaid in 2020 must be submitted to the Belgian tax authorities by 31 December 2024 at the latest. Do not miss out on this opportunity. The Belgian Private Investigation Act has come into force. Passed on May 8, 2024, and effective from December 6, 2024, this Act modernizes the legal framework for private investigations, aligning with GDPR standards to protect individual rights while supporting legitimate workplace investigations. ❗ Employers should act now to ensure they are compliant. Scope: the Act applies to both external private investigation firms and internal departments conducting investigations within companies. Certification is required for lawful operation. 🆕 New obligations for employers for using licensed investigators: ▪️ Employers must draft clear policies outlining investigation circumstances and methods, ensuring data privacy compliance. ▪️ Employees must be notified about investigation details, including purpose, scope, timeline, and their data rights. ▪️ Employers must have an appropriate clause in the work rules or a specific policy authorizing such investigations. Non-compliance can result in fines ranging from EUR 100 to EUR 25,000, invalidation of investigation findings, and reputational damage.
