Respected Narendra Modi, If we combine ancient Indian Education and modern Education system, an idle age to finish higher education has to be age 20. Early they finish education, the early the youngsters will have the energy to build skills. Whatever education follows after age 20 should be an executive or part time to update the skills and further knowledge. Focus on intense training and skill development of these people from age 21. Focus on financial literacy between age group of 12-18. So they will understand the importance of Savings habit and get motivated to invest in Banks and get knowledge of financial terms like income, interest rates,tax etc. Let them get the knowledge of fixed source of income like deposits, mutual funds, insurance and its corresponding returns. Alongwith the 35+ working age groups, focus on separate transport development for these young begginers age groups like college/office contact bus, Metros, and other public transport to encourage investment on public infrastructure and get benefits. There are students and faculties getting tired of long traveling between home and colleges. Students have to get back home and prepare for exams which is highly stressful. So in such cases focusing on a separate public transport timings for these age groups is a must. Kindly focus on training 18+ age groups for skill development on startups, entrepreneurships and jobs and make them rely less on exams that involves rote learning. Ultimately experience counts.

There has been much howling, beating of breasts and biting of ankles over the Adani story which seems to be bubbling away in a witches' (is Chudail the right equivalent in Hindi? or Petni in Bengali?) cauldron for months now. Look, the fact that corruption exists in the energy sector in India (and indeed in vast parts of the world) is well known—the economics and financials of the entire energy value chain in India are challenging, to say the least. I was a ye nipper when we moved from our government-provided bungalow to my professoriat parental units to our private home in Bhopal. The oily meter reading chap offered to reset the electricity meter so that we don't have to pay the full whack. My saintly father gaped at him and kicked him out of the house. So far so usual and anyone who thinks it's Ram Rajya in there should contact me - I have a bridge for sale. But that's not what I am talking about. What bothered me was something buried deep in the indictment. The fact that the Adani group said that they participated in the United Nations Global Compact as part of the ESG policy documented inside their dollar-denominated bonds issued in 2021 which went to US investors. As part of this UN Compact, you promise that you will work against corruption including bribery. So basically - few immediate responses 1. Before you sign up for any of these ESG declarations - well - don't because they will give rise to legal liability way into the future and come back to bite you. If you have signed up for them - think long and hard if you want to continue doing so. Can you withdraw? Is it worth the risk given simply no upside other than virtue signalling? I don't think you can, hand on heart, fulfil those declaration promises. 2. Before you even think about touching the US financial system or working in USD in any shape or form - make sure you aren't making some promises which you cannot keep. However, if you have to make a promise not to be corrupt/pay/receive bribes - then I wonder what moral standards are you working to. 3. The entire ESG investing area is now starting to smell - ironically the term itself is now toxic. Carbon reduction and heat management and water issues etc. still need to be done but broadly - I think we are done with all this blah blah blah stuff. Have a great weekend.

Case Study: Portfolio (mis)management by a reputed wealth management firm We onboarded a client with a portfolio of around INR 50 Crores, earlier managed by a big & reputed wealth management company. The portfolio was constructed for retirement purposes with 12 years of investment horizon. The risk profile of the client is moderate. When we did the portfolio health check-up, we found that there were close to 50 products in the portfolio. 40% allocation in AIFs and 20% average in debt. The annualized returns were around 10% over the last 5 years. All investments were in commission-based regular plans generating a commission of at least INR 50 LAKHS ANNUALLY for the wealth management company & client had NO idea of the hefty commissions going out every year. What's wrong with this portfolio? - Over-diversification: An ideal portfolio shouldn't have more than 15 products (max. 20 depending upon certain cases). When you invest in mutual funds, PMSs, or AIFs, the fund managers will spread the investments across multiple securities. A concentrated portfolio with high-conviction products brings better results. This is a simple understanding then why so many products? Usually, a new product offers a higher commission to distributors. This becomes a strong incentive to keep introducing new products to the portfolio. - Low returns: The underperformance was due to poor-performing equity investments across portfolio. Why these schemes were not changed could be due to the lack of focus of the relationship manager on the portfolio or higher trail commission. - Low liquidity: Excessive exposure to AIFs and some locked-in debt products offered no liquidity to swiftly change allocation in the portfolio if any opportunity arises. - Unsuitable portfolio construction: Despite a moderate risk profile, the portfolio consisted of high-risk AIFs and only around 20% in debt. This is certainly not aligned with the client’s interests. Again, reason could be that AIFs pay higher commissions than PMSs which pay higher commissions than MFs. Our solution: - Asset allocation alignment: Created a broader level asset allocation strategy across equity, debt, and gold to align with the risk profile and investment objective of the client. -Shift to zero-commission Direct Plans: Created a plan to shift all the investments gradually to direct plans of MFs, PMS, and AIFs. This will save the client upwards of INR 50 lakhs in commission payout and will be added to the portfolio gains. For our services, the client pays fees directly to us which is less than 25% of the commissions saved. - Minimize shifting costs: We removed all the underperforming funds by minimizing tax and exit load impact. - Focused portfolio: Reduced the number of products to 14 after thorough research.  The exercise took some time to complete but it was worth the effort to see a satisfied client who knows his retirement portfolio is in reliable hands. #casestudy #wealthmanagement #truemindcapital

#Switzerland plans to suspend the Most Favoured Nation (#MFN) clause in India's Double Tax Avoidance Agreements (#DTAA) from January 1, 2025. This will increase #SwissWithholdingTax on #dividend, Fees for technical services (#FTS), and #royalty payments for Indian companies operating in Switzerland through #SPVs - Subsidiaries. Further, the change raises concerns over future economic ties between the two nations affecting future tax arrangements and can especially impact over $100 billion in investment commitments under the recent European Free Trade Agreement (#EFTA) with India. Switzerland's decision to suspend the #MFN clause in India #DTAA follows a recent ruling by the Hon'ble #SupremeCourt in the #NestleSA case. The Court interpreted that the automatic application of the MFN clause in India's DTAA with Switzerland was invalid without corresponding changes in Indian tax law. Objective of MFN: MFN Clause Definition: The MFN clause ensures that a country receives the same favorable tax treatment as another #OECD country after signing a tax treaty. Impact on Taxation: It reduces withholding taxes on dividends, interest, royalties, or FTS, or may limit the scope of royalty/FTS. General Interpretation: Where a DTAA between India and any OECD country contains an MFN clause and subsequently, India enters into a DTAA with another country which provides beneficial treatment, then such beneficial treatment would 'automatically' apply to the DTAA with the first mentioned country. Interpretation by Hon'ble #SupremeCourt of India: Two fundamental questions were addressed in Nestle SA ruling - 1. Whether an MFN clause comes into effect automatically or it comes into effect only after a notification is issued by the Indian tax authorities under Section 90(1) of the Income Tax Act,1961 (#ITA). – SC observation : The binding provisions of MFN clause is not automatic unless a relevant notification is issued under section 90(1) of the #ITA to give effect to protocol. 2. Whether an MFN clause can be invoked when a third country with which India has entered into a DTAA was not an OECD member at the time of entering into such DTAA – SC observation : No. A Country becoming OECD member after signing of treaty with India, doesn’t automatically qualify for MFN benefit. The SC ruling marks a significant shift in tax treaty interpretation, particularly affecting FTS/ Royalty and dividend taxation. It aligns with global efforts like #Action15 to prevent Base Erosion and Profit Shifting (#BEPS) resulting into execution of the Multilateral Convention (#MLI), which have led to amendments in several of India's DTAAs in recent years.

The ruling from the Kerala Authority for Advance Ruling (AAR) pertains to Devalokam Bakery, which engages in the sale of various cooked items. The AAR determined that the sales of items such as Chat, Lassi, and Vada-Pav through a separate counter without a brand name qualify as 'restaurant services,' attracting a Goods and Services Tax (GST) rate of 5 percent. However, if the counter is situated within a hotel with a room tariff of ₹7,500 or more, the applicable GST rate increases to 18 percent. Devalokam Bakery, located in Ernakulam, specializes in reselling bakery products and also prepares a range of cooked items for sale at a counter in front of the shop. The bakery sought clarification from the AAR regarding the tax implications of these sales, specifically whether they would be classified as restaurant services subject to the 5 percent tax rate. The AAR concluded that the sales in question indeed fall under the category of services provided by restaurants, cafes, and similar establishments, including takeaway services. The AAR emphasized that the tax rate is contingent upon specific conditions. If the establishment is located in a commercial venue with a declared accommodation tariff of ₹7,500 or more, the GST rate is set at 18 percent. Conversely, if these conditions do not apply, the applicable rate would be 5 percent, with the provision that input tax credit has not been claimed. It is important to note that rulings from the AAR and the Appellate Authority for Advance Ruling (AAAR) are binding only on the applicants and jurisdictional tax officers, although they can influence future policy changes and may be challenged in higher courts.

💡 𝗠𝘂𝘁𝘂𝗮𝗹 𝗙𝘂𝗻𝗱𝘀 𝘃𝘀. 𝗡𝗣𝗦: 𝗪𝗵𝗶𝗰𝗵 𝗶𝘀 𝗕𝗲𝘁𝘁𝗲𝗿 𝗳𝗼𝗿 𝗬𝗼𝘂𝗿 𝗥𝗲𝘁𝗶𝗿𝗲𝗺𝗲𝗻𝘁 🤔 Meet Ram, a 40-year-old professional from Mumbai, who’s planning his retirement. Like many of us, Ram started investing in the NPS (National Pension System) because it offered tax benefits and seemed like a safe bet for retirement. However, when discussing future goals, Ram realized that while NPS would give him an annuity, it wasn’t enough to support the lifestyle he envisioned for his golden years. By opting for SWP, Ravi’s corpus continues to grow, even while he’s withdrawing money regularly. 3️⃣ 𝗧𝗮𝘅 𝗘𝗳𝗳𝗶𝗰𝗶𝗲𝗻𝗰𝘆: Did you know that withdrawals from NPS are fully taxable as income? Global billionaires as well as ultra-high-net-worth (UHNW) individuals from India are now setting up their family office branches abroad. A Henley & Partners (H&P) research suggests that 8000 of India’s richest migrated out of the country this year. The report also indicates that the trend will continue in the upcoming years as India will have a hard time keeping the riches in the country. Ambani, Asia’s second-richest man, has appointed a person to head it and his first family office outside the country is expected to be up and running in 10-12 months. A decision to relocate an Indian business to a foreign jurisdiction is a long term decision & needs a careful consideration from multiple angles & should not only be motivated by the possible tax saving (in case moving to a zero/low-tax jurisdiction).
