PROCUREMENT AND CONTRACTING REQUIREMENTS


• 1.01 EXISTING CONDITIONS
• A. Certain information relating to existing surface and subsurface conditions and structures is available
to bidders but will not be part of the Contract Documents, as follows:
• B. Geotechnical Report: Entitled Geotechnical Evaluation Report by Braun Intertec Corporation, dated
March 9, 2016.
• 1. This report identifies properties of below grade conditions and offers recommendations for the
design of foundations, prepared primarily for the use of Architect/Engineer.
• 2. The recommendations described shall not be construed as a requirement of this Contract, unless
specifically referenced in the Contract Documents.
• 3. This report, by its nature, cannot reveal all conditions that exist on the site. Should subsurface
conditions be found to vary substantially from this report, changes in the design and construction of
foundations will be made, with resulting credits or expenditures to the Contract Price accruing to
Owner.

What Is Procurement?

• Procurement is the act of obtaining goods or services,


typically for business purposes. ... Procurement generally refers
to the final act of purchasing but it can also include the
procurement process overall which can be critically important
for companies leading up to their final purchasing decision.

businesses because companies need to solicit services or purchase
goods, usually on a relatively large scale.
• A procurement contract is a written agreement between a buyer and
a seller in which the buyer agrees to purchase goods or/and services
from the seller in exchange for payment transactions. A procurement
contract states each party’s obligations and usually includes detailed
price lists, payment information, conditions of delivery and other legal
terms and conditions. There are many types of procurement
contract, including contracts with firm-fixed prices, time and
materials contracts (T&M contracts), cost-reimbursable contracts,
construction procurement contracts, etc.
Division 01
• - GENERAL REQUIREMENTS
• General Requirements: defines the specific protocols for administrative
programs associated with a given project, and each respective trade or
division (CSI), such as submittals, scheduling req’s, LEED, payment apps,
permitting, inspections, daily logs, RFIs, progress meetings and meeting
minutes, and all other project documentation. They may appear in Division 0,
within specific divisions, or both.
• General Requirements are used as the clearinghouse for items that do not
apply directly to construction, the cost of which are customarily spread out
over the entire project. These costs are also referred to as project overhead. For
estimating purposes, either term is acceptable. The important thing is to
include project overhead costs (General Requirements) in your estimate.
• General Requirements means the ancillary work and services to be
provided for the Project by the Construction Manager or the Contractor,
including its own forces for such work, for purposes such as clean-up,
miscellaneous cutting, patching, blocking and other similar work not usually
included in trade contract work and including the provision of temporary
facilities and services such as hoarding, temporary heat, site office, power,
water, security, environmental controls, and hoisting and all such services
and facilities as may be required to satisfy the intent that ancillary services
required to ensure the efficient and coordinated completion of work and
services for the Project are provided by the Construction Manager or the
Contractor as part of the General Requirements
General
• general, follow the guidelines below when dealing with General
Requirements. Unless specifically indicated otherwise, these guidelines are
not intended to restrict or replace professional judgment:
• 1. When a Design Professional is not a part of the project, the general
administrative duties relative to this section shall be the responsibility of
the primary constructor (General Contractor, Construction Manager, etc.).
• 2. If there is no primary contractor (the Owner is sub-contracting all trades),
then each trade will be responsible for the administration of their general
requirements, in collaboration and coordination with the Owne

• The Design Professional shall include a Summary of Work section in Division 1 of the Technical
Specifications.
• a. A general description of all elements of the project, including exterior work and any other related
work, is required. This description, though brief, should be complete enough for each contract so
that prospective bidders can understand the full scope. The use for which the project is being built
shall be explained. Some parts of this description can be copied from the Program Statement
• b. List the separate contracts under which the work will be accomplished and outline the scope of
work included in each contract.
• c. Work on the Other Projects: If other work, outside the scope of contracts for this project, will be
performed simultaneously with the work on this project, explain how Contractors must cooperate
with outside Contractors and with the University to avoid interference with each other's work.
• d. Do not duplicate or conflict the General Conditions or the EMU Supplementary General
Conditions found in the contract language.
