CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed at the City of ___________, this __th
day of April 2024, by and between:

Frances Madelaine Lee Chu, Filipino, of legal age, married to Goodwealth Chu, and
with residence address at 3021 Abucay Street, Tondo, Manila, hereinafter referred to
as the LESSOR.

-AND-

Elaine Joy Arogoncia Manimtim, Filipino, of legal age, and with residence address
at 20 PH 4 Tandang Sora St. St Michael Village, Sungay East, Tagaytay City,
Cavite, hereinafter referred to as the LESSEE.

WITNESSETH; That

WHEREAS, the LESSOR is the owner of THE LEASED PREMISES, a residential


property situated at Unit No.1 4334J Albina Street, Barangay 592, Zone 058, Sta.
Mesa, Manila, NCR, Philippines;

WHEREAS, the LESSOR agrees to lease out the property to the LESSEE and the
LESSEE is willing to lease the same;

NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR
leases unto the LESSEE and the LESSEE hereby accepts from the LESSOR the
LEASED premises, subject to the following:

TERMS AND CONDITIONS

1. PURPOSES: That premises hereby leased shall be used exclusively by the LESSEE
for residential purposes only and shall not be diverted to other uses. It is hereby expressly
agreed that if at any time the premises are used for other purposes, the LESSOR shall
have the right to immediately rescind this contract upon written notification to the lessee
without prejudice to its other rights under the law.

2. TERM: The term of lease is for THREE (3) MONTHS from May 15, 2024 to August
14, 2024. Upon its expiration, the parties may enter into a new lease agreement upon the
execution of a new lease contract under such terms and conditions as may be mutually
agreed upon by both parties. There is no implied new lease when the parties fail to enter
into a new lease agreement upon the expiration of this contract.

3. RENTAL RATE: The monthly rental rate for the leased premises shall be FORTY-
THREE THOUSAND Pesos Philippine Currency (Php 43,000). All rental payments shall
be paid to the LESSOR and shall be deposited to account given by the LESSOR (BPI:
Account Name-Goodyield Chu Account# 3209077751), without the need of any demand.

4. DEPOSIT: That the LESSEE shall deposit to the LESSOR upon signing of this
contract and prior to move-in an amount equivalent to the rent for FOUR (4) MONTHS
or the sum of PESOS: ONE HUNDRED SEVENTY-TWO THOUSAND (Php 172,000),
Philippine Currency. Wherein one (1) month applies for the one month advance rental
and three (3) months deposit. The security deposit SHALL NOT BE APPLIED as
monthly rental but shall be refunded to the LESSEE without interest after forty-five (45)
days upon vacating the unit at the expiration of the contract, less the cost of damage to
the unit if any, and unpaid water, electricity and other bills or resulting from violation(s)
of any provision of this contract after cut-off period.
5. ALTERATIONS: The LESSEE shall not make any permanent alterations/
redecorations/ fixtures on the lease premises without the written consent of the
LESSOR. It is expressly agreed upon herein that any fixed improvements or
renovations that will be introduced in the leased premises shall become the property
of the LESSOR after the expiration of this contract.

6. PUBLIC UTILITIES: The LESSEE shall pay for the deposit and usage of public
utilities such as telephone, electric, cable TV, water, Internet, association dues and
other public services for the duration of the lease.

7. PEACE AND QUIET: Peace and quiet shall be maintained within the property and
its premises at all times. Gambling and liquor drinking are STRICTLY PROHITIBITED
in the open spaces and all areas of the property.
The LESSOR reserved the right to stop any activity or cause the physical removal
from the property any person or any condition responsible for causing undue
disturbances or unruly behavior or harm.

8. CLEANLINESS: THE LESSEE shall keep the premises clean and sanitary at all
times and shall not store in the premises dangerous drugs, combustible and or
flammable materials such as gasoline, alcohol, or petroleum etc. Any injury or
damage caused or done by the LESSEE shall be paired by him. Hammering of nails
on the walls are not allowed. Should you wish to hang anything on the wall, secure
written consent from the LESSOR

9. GARBAGE DISPOSAL: THE LESSEE agrees to the following: Throwing of


garbage in the toilet bowl and sink is prohibited. If declogging service is needed, costs
shall be shouldered by the tenant. Trash shall be in a plastic bag with the opening
sealed or tied to avoid spillage. At no time shall garbage bags be left unattended. It is
the obligation of the LESSEE to bring out garbage in time for the garbage trucks to
collect and dispose of them properly or a fine of P 200.00 shall be imposed on every
offense.

10. COOKING EQUIPMENT: The LESSEE shall use for cooking and similar purpose
only electric current or liquefied gas, but never wood, charcoal, gas or petroleum or
other fuel that emit smoke or soot, so as not smudge or blacken the paint of the
premises;

11. FORCE MAJEURE: If whole or any part of the leased premises shall be
destroyed or damaged by fire, flood, lightning, typhoon, earthquake, storm, riot or any
other unforeseen disabling cause of acts of God, as to render the leased premises
during the term substantially unfit for use and occupation of the LESSEE, then this
lease contract may be terminated without compensation by the LESSOR or by the
LESSEE by notice in writing to the other.

12. LESSOR'S RIGHT OF ENTRY: The LESSOR or its authorized agent, shall after
giving due notice to the LESSEE, shall have the right to enter the premises in the
presence of the LESSEE or its representative, at any reasonable hour, to examine the
same or make repairs therein or for the operation and maintenance of the building or
to exhibit the leased premises to prospective LESSEE, or for any other lawful
purposes which it may deem necessary.

13. DEFAULT PAYMENT AND VIOLATION OF CONTRACT: In case of delay in


the payment of the rent, such as when the checks are dishonored, or violation of any
condition of this lease contract, the LESSOR, at its option, may terminate this contract
and eject the LESSEE. The LESSOR has the right (a) to padlock the premises (b) to
enter the premises by breaking the locks and doors, (c) to remove the LESSEE’s
equipment, furniture and other effects and properties and hold the same to answer for
the rental due, and (d) to make the leased unit available for occupancy to other persons
desiring to lease the same when the LESSEE is in default of payment for One (1) month
or for any violation of this leased contract and may forfeit whatever rental deposit or
advances have been given by the LESSEE. There is delay in the payment of the rent
when the rental payment has not been paid on the 1st day of the month, without the
need of any demand on the part of the LESSOR.

14. ESCALATION: Should this lease of contract be agreed upon to be renewed, the
LESSOR will impose a 10% yearly escalation

15. EXPENSES: the LESSEE shall at his/her own expenses, not subject to
reimbursement make all minor and necessary repairs in the leased premises such as
electrical, carpentry, masonry, plumbing, clogging of water pipes, water drainage,
lavatory, kitchen sink, and toilet bowl during the term of the contract

16. EXPIRATION OF LEASE: Upon the expiration of the lease term of or upon the
rescission/ cancellation thereof, as herein provided, the LESSEE shall promptly and
peacefully deliver to the LESSOR the leased premises with all corresponding keys and
in as good, clean, sanitary and tenable condition as the same is now, reasonable and
ordinary wear and tear excepted, devoid of all occupants, movable furniture, personal
articles and effects of any kind. Non-compliance with the terms of this clause by the
LESSEE will give the LESSOR the right, at the latter’s option, to refuse to accept the
delivery of the premises and compel the LESSEE to pay rent therefrom at the same
rate plus twenty-five 25% thereof as penalty until the LESSEE shall have complied
with the terms hereof. The same penalty shall be imposed in case the LESSEE fails to
leave the premises after the expiration of this contract of lease or termination for any
reason whatsoever

17. PRE-TERMINATION OF CONTRACT. Should the LESSEE decide to vacate the


said premises prior to the expiration to this contract of lease, the LESSEE shall give
the LESSORS THIRTY (30) DAYS written notice prior to the effectivity of the
termination and the security deposit and any unused advanced rentals shall be
forfeited within the period above mentioned from date of termination. Likewise, should
the LESSOR wants the LESSEE to vacate the said premises before the expiration of
this contract of lease, the LESSOR shall give the LESSEE THIRTY (30) DAYS written
notice. Failure on the part of the LESSEE to initiate negotiations for the renewal of the
LEASED PREMISES within THIRTY (30) DAYS prior to the expiration of the term of
the lease shall give the LESSOR the right to show the LEASED PREMISES to other
prospective tenants.

18. DOCUMENTARY STAMP TAX. Any documentary stamp tax due on this contract
shall be for the account of the LESSEE.

19. JUDICIAL RELIEF: Should any one of the parties herein be compelled to seek
judicial relief against the other, the losing party shall pay an amount of One Hundred
(100)% of the amount clamed in the complaint as attorney's fees which shall in no case
be less than P50,000.00 pesos in addition to other cost and damages which the said
party may be entitled to under the law.

20. NO RIGHT OF FIRST REFUSAL: The LESSOR may sell/ assign the leased
premises without first offering the same to the LESSEE.

21. This CONTRACT OF LEASE shall be valid and binding between the parties, their
successors-in-interest and assigns.

22. ENTIRE AGREEMENT: This agreement constitutes the entire agreement


between the LESSOR and the LESSEE. No oral agreements have been entered into,
and all modifications or notices shall be in writing to be valid.
