1. The instant petition has been filed under Section 438

Cr.P.C., whereins, the petitioner seeks the indulgence of this court for

grant of anticipatory bail.

2. FIR No. 243 dated 29.08.2015 is registered at Police

Station City Tarn Taran, District Tarn Taran, thereins, offences

constituted under Sections 419, 420, 465, 468, 120-B of the IPC, are

embodied.

3. The incriminatory roles as assigned, in the petition FIR, is

that the present bail petitioner in connivance with co-accused Karanbir

Singh, and, co-accused Manjinder Singh, and, for a monetary quid pro

quo preparing fake arms licences, and, thereafter, theirs also facilitating

the purchases of arms by the persons concerned.

4. During the course of investigations into the petition FIR,

accused Karanbir Singh has been arrested, but during his custodial

interrogation, he did cause recoveries of fake arms licences to the

investigating officer concerned.

5. Be that as it may, the present bail petitioner is an employee

in the licensing branch, at the Civil Collectorate, at Tarn Taran, and, his

seat is in the closest proximity to the photostat booth, of his nephew

one Manjinder Singh. It appears that copies of fake arms licences, as

may have become ultimately issued from the licensing branch

concerned, where the present bail petitioner is working as a Licensing

Clerk, became thereafter photostated at the booth of his nephew one

Manjinder Singh. Therefore, the nephew of the present bail petitioner

may have now rather not maintained records thereof. However, for

ensuring that the present bail petitioner, discloses to the investigating

officer concerned, the numbers of all the fake licenses, as became

prepared by him, in collusion with all concerned, and, whereafter(s) he

prima facie facilitated the purchases of arms, by the concerned, and,

also after his receiving monies from them, hence the custodial

interrogation of the present bail petitioner rather is deemed most

imperative.

6. The further reason for forming the above conclusion, is

founded upon the inferences, and, conclusions, as, become drawn by

this Court, where declining relief of pre-arrest bail, to Karwinder Singh,

through an order of even date rendered in CRM-M-15562-2022.

7. Consequently, for uncovering the scale of preparations of,

and, supply of fake Arms Licenses to the concerned, and also, for

ensuring recoveries thereof, besides for ensuring the eruption(s) of the

names of persons who therethrough(s) purchased arms, thereupon(s), it

is too, deemed necessary to order for the custodial interrogation of the

present bail petitioner.

8. In view of the above, this Court does not find any merit in

the petition, rather, becomes constrained to dismiss it.

9. Dismissed accordingly.

10. The afore observations are meant only for the disposal of

the present petition, and, shall not affect the merits of the trial arising

from the FIR (supra).
