Dear Sir,
Under instructions from and on behalf of my client Mr.
Pankaj Bhagi, S/o Shri Subhash Bhagi, R/o F-7, Kalkaji, New Delhi, I hereby serve upon the you the addressee the following notice:
1. That my client entered into an agreement to sell dated
09.03.2021 with respect to property bearing no. F-28, Kalkaji, New Delhi-110019.
2. That the entire consideration amount in respect of the above
said property was fixed between the parties at Rs._______ out of which you the addressee has received a sum of Rs._______.
3. That my client has made payment of Rs._______ on against
the above quoted amount.
4. That as per clause 3 of the agreement, on receiving full and
final sale consideration in respect of the said property, you the addressee shall hand over the actual physical vacant possession of the property to my client. 5. That despite the full and final payment of the above said consideration amount, you the addressee has miserably failed to deliver the possession of the above said property in favor of my client.
6. That as per clause 11 of the agreement to sell, if the FIRST
PARTY i.e. you the addressee refuses to execute the sale deed in favor of the SECOND PARTY due to any reasons, then he shall be liable to pay the double amount.
7. That since my client has already paid the said amount on
_______ and you the addressee have failed to deliver the possession, therefore, you have violated the clause 11 of the said agreement to sell.
8. That as per clause 12 of the agreement, in case of non-
observance or performance of the contents of the agreement to sell, my client is entitled for refund of the amount already paid by my client for the purchase of the above said property along with interest @____________.
9. That you the addressee is liable to pay/refund the above said
amount along with interest @________ to my client within ________ days.
I, therefore, call upon you the addressee through this
legal notice to refund the amount of Rs.________ along with interest to my client within ______ days from the receipt of this legal notice, failing which my client has given me clear instructions to file civil as well as criminal suit and other Miscellaneous proceedings against you in the competent court of law and in that event you shall be fully responsible for the same. A copy of this legal notice has been retained in my office for further action.
