ABOUT MADHUSUDAN LAW UNIVERSITY
The Indian judiciary grapples with a daunting backlog of over 4.48 crore pending cases, further exacerbated by
the challenges posed by the COVID-19 pandemic. In response to the existing judicial system's struggle to manage
this escalating burden, there is a compelling call for the intervention of Alternative Dispute Resolution (ADR).
Recognizing the constitutional imperative that "Justice delayed is justice denied" under Article 21, ADR emerges
as a crucial mechanism to deliver prompt justice, alleviate the backlog, and enable judges to redirect their focus
towards pivotal cases. This initiative aligns with global preferences, as over 200 countries engage in negotiation
treaties, emphasizing the international appeal of ADR for streamlined and time-efficient dispute resolution
mechanisms. Alternative Dispute Resolution (ADR) is popular due to its quicker, flexible, and confidential
nature, empowering parties and gaining international acceptance for streamlined, efficient resolution. In 1996,
the Indian Parliament introduced the Arbitration and Conciliation Act, outlining detailed provisions for the
resolution of legal disputes, and in 1999, the CPC Amendment Act inserted Section 89 into the Code of Civil
Procedure 1908, facilitating the settlement of court cases through ADR. In addition to constitutional support
(Article 39A), various statutes like the Industrial Disputes Act, Commercial Courts Act, Hindu Marriage Act,
Consumer Protection Act, Motor Vehicles Act, etc., endorse ADR mechanisms for dispute resolution. Notably,
recent amendments include The Mediation Act, 2023, reflecting an ongoing effort to enhance and refine ADR
processes in India.
Against this backdrop, the Emerging Areas of Law Cluster at Madhusudan Law University, Cuttack, is set to
spearhead a thought-provoking discussion titled "Alternative Dispute Resolution : challenges and future
perspectives." This forum aspires to be a collaborative platform for legal professionals and scholars, facilitating
an in-depth exploration of various facets of ADR, evaluating emerging trends, and fostering discussions on
effective implementation strategies and avenues for improvement. Through this seminar, the university aims to
contribute significantly to a nuanced understanding of ADR's potential impact on the judicial landscape and
underscore its pivotal role in addressing contemporary legal challenges.
