EMPLOYEE AGREEMENT

Dear______________________,

Further to our discussion, we are pleased to offer you employment with MERIDIAN
FITNESS India in the position of "Fitness Trainer" and you will be required to discharge the
responsibilities assigned to you by the Company from time to time. You will be located in
Bangalore.

Your employment as _______________ on the following terms and conditions:

 Your offer has been made based on information furnished by you. However, if
there is a discrepancy in the copies of documents or certificates given by you as a
proof of above, we reserve the right to review our offer of employment.
our total package (Gross Salary) will be Rs_________Per Month
(Rupees________________________________) Rs___________ Per Annam. This
includes Basic + DA, Allowances, Statutory contributions and other benefits as
governed by company policies, subject to Income Tax regulations, ESI, Legal
Compliances in force from time to time.
1.Date of joining: _________________The detailed salary structure is as per the
enclosed Annexure-A.
 2.You will be on probation for a period of 90 days from ____/___/2022. Probation
period may be extended, at the sole discretion of the management. No Leaves during
the probation period.
3. In the company your training period would be for a month & in your probation
period if your performance is not satisfactory and do not show the expected
performance or remain absent without prior permission, in this event the company
reserve the right to terminate your employment immediately without any notice/pay.
In case employee is terminated/resigned within the period of 1 year from the date of
joining, employee is liable to pay 5% on Annual CTC Towards Hiring & Training
charges.
4. In the event of any misbehaviours or malpractices your employment will be
terminated immediately & appropriate action will be initiated against you if the
circumstances warrants.
5. In case of resignation, you are required to serve 30 days’ notice period during
probationary period, after confirmed you need to serve 45 days' notice period. In the
event of non-service of notice period payment to that effect will be deducted from
your full & final settlement.
6. Please sign and return duplicate copy of this letter in acceptance of the above.

 7. Date of Birth: The date of birth declared by you is (DOB) and you will
be bound by such date of birth in all service matters.
 8. Retirement Age: You will retire from the service of the MERIDIAN FITNESS
on attaining the age of 50years.
 9. Posting and Transfer: Your place of work, in the first instance, is as
indicated above. However, you can be transferred temporarily or
permanently for duty anywhere in Bangalore, depending upon the needs
     of the organization. Your service may be transferred to any office of the
    MERIDIAN FITNESS or its associated organization in Bangalore depending upon
   the exigencies of work. You will be governed by the transfer rules prevailing
  in the MERIDIAN FITNESS at any given point in time.

CONDITIONS OF EMPLOYMENT:

Employee CTC includes Basic + DA, Allowances, Statutory contributions and other benefits
as governed by company policies, subject to Income Tax regulations, ESI, Legal
Compliances in force from time to time. The variable salary and incentive structures will be
decided and enforced by management directives on the basis of Club performance and
will not be altered on the request of any employee.

Pay day on 10th of every month and attendance cycle from 25th of last month to 24th
of current month.

The first 30 days following onboarding will be a training period, within which the franchisee
reserves the right to terminate employment on the grounds of Non-performance (Willingness
to learn & comply or inability to perform), disobedience or misconduct. Any employee
terminated within this period is not entitled to any salary or severance pay.

In the company your training period would be for a month & in your probation period if your
performance is not satisfactory and do not show the expected performance or remain absent
without prior permission, in this event the company reserve the right to terminate your
employment immediately without any notice/pay. If any new joiner leaves the organization
within a period of one month of employment from the date of joining, the individual will not
receive their salary or incentive for the particular month. Employees are entitled to their
monthly salary only upon completion of the 30-day period as per the club salary cycle.

Employee will be on probation for a period of 90 days from the date of Joining. Probation
period may be extended, at the sole discretion of the management. No Leaves during the
probation period. The company will provide you extensive training during the first three
months of your employment with us and expects you to return the investment made on this
training in the form of personal value addition to the company. The training materials
provided to you are property of the company and confidential information. Carrying the
materials outside the company or disclosing them to anyone other than employees of the
company is a breach of trust and will result in immediate forfeiture of the holding amount and
termination of employment without notice.
The first three months of any employee's term of employment will not have any allowance for
paid leave/vacation leave. Any unplanned or unapproved leaves will be penalized with loss
of pay for 2 days. If the leave is approved, loss of pay will only amount to one day's salary.
All leaves should be applied in advance unless circumstances are such that it is not possible
to do so. In such cases a telephone call/ message or an email to the concerned reporting
authority or his/her absence to the concerned department, as intimation should serve the
purpose

If any employee leaves within a period of 6 months, an amount of 10% of their annual
CTC will be deducted from their full and final settlement. If the employee leaves after
having served the organization between 7-12 months, 5% of their CTC will be
deducted from their final settlement towards hiring & training charges.

In case of resignation, you are required to serve 30 days' notice period during probationary
period, after confirmed you need to serve 45 days' notice period. In the event of non-service
of notice period payment to that effect will be deducted from your full & final settlement, F&F
will be processed within 45 days from the date of resignation.

Any amount spent on club merchandise on the employee (ID Cards, T-shirts and Uniforms)
will also be deducted from the CTC of any departing employee if they choose to leave within
a period of 12 months. Employees are strictly prohibited from taking any payments from club
members into their personal bank accounts, nor are any gifts or loans permitted to be taken
from clients. You will devote full time to work of company and shall not undertake any direct
/indirect business or work, honorary or remunerative, expect with the written permission of
Management. 
Employees are not permitted to disclose any company secrets or methods of operations.
"Confidential information" shall include all trade secrets, all information which has been
specifically designated as confidential by the Company, any information which relates to the
commercial and financial activities of the company or any such confidential information
concerning any other company any of its or their suppliers, agents, distributors or customers,
the unauthorized disclosed of which may embarrass, harm or prejudice the Company. It
does not extend to information already in the public domain unless such information has
arrived there through unauthorized means, all notes and memoranda of any Confidential
Information which shall be the property of the Company and shall be surrendered by you to
Someone duly authorized in that behalf at the termination of your employment. Any
confidential information possessed by you must be deleted or removed from any personal
devices you use. Management is entitled to take legal action if it is revealed that you
disclosed company confidential information like member details or any company secrets,
methods of operation or if you involve in working with a customer with whom you have had
worked in the company after employment is ended or terminated.

The management reserves the right to terminate the services of any employee on the basis
of performance review at any point of time. Any dissent or spreading negativity shown
towards management directives or in the event of any misbehaviours or malpractices your
employment will be terminated immediately & appropriate action will be initiated against you
if the circumstances warrant.
You will be responsible for safekeeping and return in good condition and order of all
Company property, which may be in your use, custody or charge. Any losses occurred due
to the negligence or irresponsible behaviour of the employee! Complete loss will be
recovered from the employee.

Employment as per this offer is subject to your being medically fit.

The above terms and conditions are based on the company's policy, procedures and other
rules currently applicable are subject to amendments and adjustments from time to time.
These policies are basically guidelines and the management reserve the right to withdraw/
modify to suit organization's philosophy at any time without assigning
any reason whatsoever.
Acceptance: I have read and understood the above terms and conditions mentioned in this
letter of conditions of employment and I hereby confirm unconditional acceptance of the
same.
