CONTRACT OF TEMPORARY EMPLOYMENT

(OFFICE STAFF)

KNOW ALL MEN BY THESE PRESENTS:

This Probationary Employment Contract is executed on (insert date) at (insert place), by

WITNESSETH THAT:

WHEREAS, the Employee recognizes that the Employer is involved in the Engineering
Construction, Consultancy and Supply of Electrical Equipment. Cognizant to this, the Employee
wishes to be employed by the Employer.

NOW, THEREFORE, in consideration of the mutual covenants and agreement set forth below,
it is hereby covenanted and agreed by the Employer and the Employees as follows:

1. DURATION OF EMPLOYMENT: The employment commences on March 1, 2023 and


shall continue thereafter until May 31, 2023 unless terminated by either party for just
cause.

2. DUTIES OF THE EMPLOYEE:

2.1 Handling incoming calls and other communications.


2.2 Managing filing System.
2.3 Recording information as needed.
2.4 Updating all paperwork, maintain documents and word processing.
2.5 Helping organize and maintain office common areas.
2.6 Performing general office clerk duties and errands
2.7 Organizing travel by booking accommodation and reservation needs as required.
2.8 Coordinating events as necessary.
2.9 Maintaining supply inventory.
2.10 Creating, maintaining, and entering information into databases.
2.11 Other task that may assign by the immediate supervisor.

3. EMPLOYEE’S STATUS: Temporary


Your performance shall be evaluated based on the following standard/ criteria:

a.) Competence in your assigned work/task/job;


b.) Industriousness
c.) Diligence
d.) Efficiency
e.) Faithful compliance policies, rules, regulations, instructions and guidelines
f.) Working attitude and relation with superior (s) and co-workers; and
g.) Loyalty to the Company

Violations of company policies, rules, regulation, instruction, and guidelines or


unsatisfactory performance within three (3) months contractual employment period will
result in termination of this contract/ agreement.

4. BASIC GROSS MONTHLY SALARY: Php 17,000.00 per month exclusive of


allowance to be paid on 15th and 30th of each work month.

5. HOURS OF WORK, REST DAYS AND VACATION LEAVE: Eight (8) hours/ day,
Six (6) days a week; with one (1) rest day per week including legal working holidays.

5.1 Work in excess of eight (8) hours shall entitle the EMPLOYEE to overtime pay.
Work performed during rest days and legal holidays shall entitle him/ her to premium
pay in accordance with the law of the place of employment.
5.2 EMPLOYEE shall be entitled to a total of five (5) day vacation and sick leave. The
unused leave will not be convertible to cash.

6. NON-COMPETITION: During the period of employment under the Agreement.


EMPLOYEE shall not directly, or indirectly, own, manage, operate, join, control, be
employed by or participate in the ownership, management, operation, or control of, or be
connected in any manner with any business in competition with, directly or indirectly, or
similar to the business of EMPLOYER.

7. TERMINATION OF CONTRACT:
7.1 Termination by EMPLOYER: EMPLOYER may terminate this contract on the
following just causes: Serious misconduct or willful disobedience by the
EMPLOYEE of the lawful orders of the EMPLOYER in connection with his/ her
work; habitual neglect of duties by the EMPLOYEE and other similar just causes as
determine by DOLE.
7.2 Termination by the EMPLOYEE: EMPLOYEE may terminate the contract
WITHOUT JUST CAUSE by serving a written notice to the EMPLOYER at least
one (1) month in advance. EMPLOYEE may also terminate the contract by serving a
written notice to the EMPLOYER at least (10) days prior to separation if WITH
JUST CAUSE.

8. CONFIDENTIALITY: During and after Employment period, the Employee will not
divulge or appropriate to his own use or to the use of other’s in competition with
Company. Any secret or confidential information or knowledge pertaining to the business
of the Company, or its subsidiaries, obtained by him/ her in any way while he/ She was
employed by the Company or by any of its subsidiaries.

9. AMENDMENT: This Agreement may be amended only by a writing signed by


EMPLOYEE and by a duly authorized representative of the Company.

10. SEVERABILITY: If any term, provision, covenant or condition of this agreement or


the application thereof to any person, place or circumstances, shall be held invalid,
unenforceable or void, reminder of the Agreement and such term, provision, covenant or
condition as applied to other person, places and circumstances shall remain in full force
and effect

11. SOLICITATION: The Employer further agrees that during term of this agreement and
following the termination of this Agreement, whether the termination shall be voluntary
of with of without cause, or whether the termination is solely due to the expiration of the
term of the Agreement, the Employee will not, in any manner or at any time, solicit or
encourage any person, firm, company, or other business entity who are clients, business
associates or referral sources of the Company to cease doing business with the Company
or to do business with the company or to do business with the Employee.

12. INDEMNIFICATION: The Employee hereby agrees to indemnify and hold the
Company and its officers, directors, shareholders, and executives harmless from and
against any loss, claim, damage, or expenses and/or all cost prosecution or defense of
their rights hereunder, whether out of court, including without limiting the generality of
the foregoing attorney’s fees and all cost and expenses of litigation, arising from our
growing out of the Employee’s breach or threatened breach of any covenant contain
herein.

13. LIMITATION ON AUTHRORITY: Without the express written consent from the
Company, The Employee shall have no apparent or implied authority to: (i) Pledge the
credit of the Company and its other Executives (ii) Bind the company under the any
contracts, agreement, note mortgage, or otherwise; (iii) Released of discharge any debt
due the company unless the company has received the full amount hereof of (iv) Sell,
mortgage, transfer or otherwise dispose of any assets of the Company.

IN WITNESS WHERE OF, the contracting parties have read carefully and fully
understood the terms and condition of this contract, hereunto set their signatures, THE
