Agreement for Sale of a House

This Agreement of sale made and entered on this 17 th day of December 2021 at
Mysore

BETWEEN
1) Smt. Manjula, W/o Sri, Late Nagaraju,
2) Smt. Nagarathna D/o Sri, Late Nagaraju
3) Smt. Vijayalakshmi N D/o Sri Late Nagaraju
Residing at No 8/1A Pension Block Rajendra Nagar Mysore herein after referred to
as the Seller (which expression shall mean and include her legal heirs,
representatives, agents, executors, successors and assignees etc.,)
AND
Shi. Ravi R Son of Sri Ramesh N., residing at No 4/2 1 st cross pension block
Rajendra Nagar Mysore hereinafter referred to as the PURCHASER (which
expression shall mean and include their legal heirs, representatives, agents,
executors, successors and assignees etc.,)
WITHNESSETH AS FOLLOWS:
Whereas the said Seller has purchased the schedule property through registered
sale deed, registered as document no. 1766 of Book-1, Vol

Thus the Seller is in possession and enjoyment of the schedule mentioned self
acquired property having absolute ownership with disposal right, title and interest
over the same and enjoying the same peacefully without any obstruction from any
other persons.
TERNS AND CONDITIONS
1. The entire sale consideration agreed by both the parties for a total sum of
Rs.23,00,000/- (Rs. Twenty Three Lakh only)
2. The Purchaser herein has paid a sum of Rs.50,000/- (Rs. Fifty Thousand
only) to the Seller by way of cash as advance before withnesses and the
Seller acknowledges the same.
3. The Purchaser has agreed to pay the balance consideration of Rs.22,50,000/-
(Rs. Twenty Two Lakh Fifty Thousand Only) to the Seller at the time of
registration.
4. The stipulated period for the completion of entire transaction is fixed up to (3)
Three months from today.
5. The Seller has agreed to hand over vacant possession of the schedule
property to the Purchaser at the time of registration.
6. The Seller herewith agreed to Clear all disputes and loan, if any, before
registration at his/her own cost.
7. The Purchaser has all rights to get the property registered in his name or any
other person/s as he/she desires
8. The Seller assures the Purchaser that she/he has not created any charge or
entered into any agreement of sale with any other person/s so far, other thatn
this agreement regarding the schedule property.
9. The same is subjected to clear, perfect and marketable title of the Seller
regarding the schedule property.
10. The Purchaser shall bear the stamp duty, registration charges and other
incidental expenses for registration.
11. The Seller herewith agreed to produce up to date tax paid receipt, khatha, E.C
Form-9 Form-3 (KEB/Water) UPOR (if, mandatory) and all other necessary
documents/ corrections before registration.
12. In the event of breach of teh terms of this agreement either of the party is
entitled to claim an amount of Rs.1,000/- ( Rs. One Thousand Only) towards
the expenses and losses incurred by the aggrieved party as penalty.
13. Time agreed as per this agreement is essence of this agreement failure to
comply the agreement amount to breach of contract and both are severely
responsible to go within this contract at this specific date and time and
respectively to perform the specific agreement mentioned as above.

West by : Nilaya Property
North by : Road
South by : Vijayakumar Property

Measuring East to West : 10.6 Ten Ft, Six In., and North to South : 50 Fifty Ft
(530 Sq.Ft.,) of site with residential house along with electric, water and
sanitary facilities therein.

In witness whereof the Seller and Purchaser have executed this agreement
on the day, month and the year first above written in the presence of the
witnesses.

NOW this Agreement Witness as Follows


1.   The vendor will sell and the purchaser will purchase that entire house No 8/1A
Pension Block Rajendra Nagar Mysore more particularly described in the
Schedule hereunder written at a price of Rs 23,00,000 (Twenty Three Lakhs
Only). Free from all encumbrances.
2.   The purchaser has paid a sum of Rs 50,000 (Fifty Thousand Only) as earnest
money on Cash Basis on 01st Day of December 2021 (the receipt of which
sum, the vendor hereby acknowledges) and the balance amount of
consideration will be paid at the time of execution of conveyance deed.
4.   The vendor shall submit the title deeds of the house in his possession or
power to the purchaser's advocate within one week from the date of this
agreement for investigation of title and the purchaser will intimate about his
advocate's.
5.   The vendor declares that the sale of the house will be without encumbrances.
6.   The vendor will hand over the vacant possession of the house on the
execution and registration of conveyance deed.
7.   If the purchaser commits breach of the agreement, the vendor shall be
entitled to return 50,000 within one week of breach of agreement and the
earnest money paid by the purchaser to the vendor and the vendor will be at
liberty to resell the property to any person.
8.  The vendor shall execute the conveyance deed in favour of the purchaser or
his nominee as the purchaser may require, on receipt of the balance
consideration.
9.  The expenses for, preparation of the conveyance deed, cost of stamp,
registration charges and all other cut of pocket expenses shall be borne by
the purchaser.

IN WITNESS WHEREOF the parties have set their hands to this Agreement on 17 th
day of December 2021 first hereinabove written.
