Performance Task: Position Paper on the Use of President Duterte’s

Learning Target: To analyze how the special powers of President Duterte was

used during the pandemic.

Prompt Question: Do you believe that the special powers of President Duterte,

granted to him through the Bayanihan to Heal as One Act or Republic Act 11469,

was used responsibly during this pandemic?

The Bayanihan to Heal as One Act, or Republic Act No. 11469, was signed into law

by President Rodrigo Duterte on March 26, 2020, following the President's appeal to

Congress for emergency powers to fight the COVID-19 epidemic. The bill gave the

President the authority to impose temporary emergency measures in response to the

pandemic's crisis. The legislation requires patients to be isolated and treated

immediately, and the expense of such treatment for COVID-19 patients is paid by the

Philippine Health Insurance Corporation's National Health Insurance Program

(PhilHealth). The covid pandemic is posing significant challenges to the Philippines.

We are assisting the most vulnerable children, particularly girls and young women,

who are affected by this catastrophe. Many individuals have lost their employment

and livelihoods as the number of positives in COVID 19 has increased.

Duterte is granted 30 powers in the final form of the legislation passed by the

Senate and ratified by the House of Representatives. Among the provisions of the

bill is the ability to provide P5,000 to P8,000 in emergency financial assistance to 18

million low-income families, based on the region's minimum wage. In addition, the

legislation guarantees that health professionals get a specific risk allowance in

addition to their normal hazard pay. It also instructs the Philippine Health Insurance

Corporation (PhilHealth) to cover any medical expenses incurred by personnel

exposed to the coronavirus during the emergency. The law also requires that

P100,000 be awarded to public and private health professionals who suffer serious

coronavirus illness (COVID-19). Families of health professionals who died from

COVID-19 in the course of duty would be awarded P1 million retrospectively.

The authorities specified in the Bayanihan Heal as One Act are based on Article

VI, Section 23 (2) of the Philippine Constitution. This clause empowers Congress to

adopt legislation enabling the President "to employ powers necessary and suitable to

carry out a stated national policy" "in times of war or other a state of emergency.”

The law gives Duterte the authority to take over private medical institutions as well

as public transportation. According to Executive Secretary Salvador Medialdea, the

provision was merely intended to provide Duterte "standby power." Section 17 of

Article XII of the Constitution served as the foundation for this., which empowers the

State "during the emergency and on fair terms established by it, to temporarily take

over or direct the operation of any privately held public utility or company impacted
with public interest." Bayanihan to Heal as One Act would "authorize the President to

utilize powers necessary to carry out immediate steps to meet the present national

emergency pertaining to COVID-19."
