TRUCKING SERVICES AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This agreement is entered into by and between the following parties to


wit:

Mrs. Danielle Aranda, of legal age, Filipino citizen, married and with
residence and postal address at Rizal Street, Barangay Sta. Catalina,
Lubao, Pampanga, hereinafter referred to as FIRST PARTY;

and

Trucking Business, Inc., a corporation duly organized, registered and


existing under the laws of the Republic of the Philippines, with
principal office or place of business at Palms Tower, Paco, Manila,
hereinafter referred to as SECOND PARTY;

WITNESSETH:

That the FIRST PARTY is engaged in the business of transporting


freight from Luzon to any point in the Philippines;

That the SECOND PARTY desires to engage the services of the


FIRST PARTY in transporting her goods, particularly mangoes,
tamarinds, and bananas;
WHEREFORE, in consideration of the mutual covenants and
agreements set forth herein, the parties do hereby agree as follows:

1. This agreement shall be valid for a period of ONE (1) YEAR


commencing on December 26, 2020, and may be renewed thereafter
upon agreement by the parties;

2. The FIRST PARTY hereby agrees to furnish and operate its motor
vehicle with Type: FUSO and Plate No: GWH 131 together with
drivers to deliver the mangoes, tamarinds, and bananas from Javier
Street, Barangay San Antonio, Lubao, Pampanga to Bulacan and
Balintawak Public Market;

3. In the event the mentioned motor vehicle will not be available due
to mechanical breakdown, the FIRST PARTY shall provide
substitute units of the same or comparable make and tonnage
capacity;

4. The FIRST PARTY shall ensure the road worthiness of the trucks to
vouch that they are fit or suited for the cargo transport;

5. That for the full and proper performance of each trip made by the
FIRST PARTY, the SECOND PARTY agrees to pay the former the
rate of P7 per kilogram of mangoes, tamarinds and bananas to be
transported, payable upon completion of the delivery of the said
fruits by the FIRST PARTY;
6. That the SECOND PARTY shall secure the services of the FIRST
PARTY four (4) times a month;

7. That the FIRST PARTY binds himself to make available any of this
vehicles upon prior notice and whenever need by the SECOND
PARTY for the transporting of her goods within the duration of this
agreement;

8. That the FIRST PARTY shall exercise the diligence required of him
in the conduct of his operations, and any loss caused to the
SECOND PARTY owing to delay, negligence and imprudence on
the part of the FIRST PARTY , in accordance with existing laws
governing and applicable to public carriers;

9. This agreement does not in anyway create an employee-employer


relationship between the parties.

IN WITNESS WHEREOF, the parties have hereunto set their hands


this 16th day of December 2018 in Paco, Manila, Philippines.

2. DANIELLE ARANDA, with a competent proof of identification:
Philippine Passport with number M0993353 which expires on 15
May 2027;

to me known and by me known to be the same persons who executed


this Trucking Services Agreement consisting of three (3) pages
including this page where the acknowledgment is written and they
acknowledged before me that the same is their free and voluntary act
and deed as well as the entities they represent.
