CONTRACT TO SELL

Know all men by these presents:

This instrument made and executed this 31st day of July 2018 by and between:

NESTOR T. CABULLO, of legal age, Filipino, married to Emedina E.


Cabullo, and a resident of #36 Ugac Sur, Tuguegarao City, Cagayan, hereinafter
referred to as the VENDOR; and

SPOUSES ANTONIEL T. GUZMAN AND DINA JOY C. GUZMAN, both


of legal age, Filipinos, and residents of 36 Ugac Sur, Tuguegarao City, Cagayan,
hereinafter referred to as the VENDEES.

WITNESETH:

THAT the vendor is the absolute and registered owner of a parcel of land more
particularly described as follows, to wit:

Transfer of Certificate of Title No. T-60079

“A parcel of land (Lot 1411-D-4, of the subdivision plan(LRC)


Psd-135265, being a portion of Lot 1411-D, Psd-99750, L.R.C. Cad Rec.
No. 423), situated at Barrio of Ugac Sur, Municipality of Tuguegarao,
Province of Cagayan, Island of Luzon.

Beginning at a point marked ‘1’ on the plan being N. 16 deg.
02’W., 646.43 m. from B.B.M. No. 5, Tuguegarao, Cadatre; thence S. 88
deg. 27’E., 12.55 m. to point 2; thence S. 05 deg. 59’E., 11.43 m. to point
3, thence S. 86 deg. 51’E., 2.73 m. to point 4; thence S. 04 deg. 01’E., 3.14
m. to point 5; thence S. 85 deg. 20’S., 18.04 m. to point 6; thence N. 15
deg. 37’W., 17.24 m. to point 7; thence S. 88 deg. 39’E., 5.93 m. to the
point of beginning, containing an area of TWO HUDNRED SEVENTY
SEVEN (277) square meters, more or less.”

THAT the vendor agreed to sell the afore-described property together with its
improvements to the vendee under a conditional sale and the vendee accepted the
conditions, to wit:

1. That the vendees hereby agree that the purchase price of the above-described real
property will be ONE MILLION FIVE HUNDRED THOUSAND PESOS
(P1,500,000.00);

2. That the vendees shall upon execution of this contract file their application of a
loan for lot purchase before the PAG-IBIG (HDMF) Tuguegarao City, Cagayan;

3. That the full payment for the above-described property shall be payable upon
release of the proceeds of the said loan;

4. That in the event that the proceeds of said loan will be less that the purchase price,
the vendee undertake to pay the remaining balance;

5. That the vendee agreed that the application of the loan for lot purchase with the
PAB-IBIG will be processed after due execution of this contract;
6. That upon payment of the total purchase price, the proper and sufficient deed or
sale and conveyance for the above-described property subject of this contract free
and clear from all liens and encumbrances except such as may be subsisting by
operation of law shall be executed;

IN WITNESS WHEREFORE, the parties have set their hands at Tuguegarao


City, Cagayan on the date above-mentioned.
