“The great liability of the engineer compared to men of
other professions is that his works are out in the open We all make mistakes
where all can see them. His acts, step by step, are in
hard substance. He cannot bury his mistakes in the Engineers deal with public safety - the stakes are high
grave like the doctors. He cannot argue them into thin
air or blame the judge like the lawyers. He cannot, like The consequences of failure are unthinkable
the architects, cover his failures with trees and vines.
He cannot, like the politicians, screen his short-comings We have a duty to check and double check our work
by blaming his opponents and hope the people will
forget. The engineer simply cannot deny he did it. If Checking is designed to reduce the number and
his works do not work, he is damned.” significance of the mistakes we make

Mistakes may occur due to ignorance, carelessness When a failure occurs and human error is a factor,
or a number of other factors. either

They may occur in design, construction, •someone didn’t check carefully enough, or
maintenance or demolition.
•someone did not act promptly upon warnings
arising from someone else’s check.

Formal Technical Approval implies certification of the design by both
the Designer and the Checker.

• Designer and Checker are both theoretically liable. • But, in the UK, the law allows the Checker to be 100%
• Claims may be made against both parties. liable if the Designer is not able to pay!
• The share of liability is decided between the parties or • Also, the Client cannot contract out of his legal liability
by the courts. (Typically in the ratio 60:40 or 70:30) under current Health and Safety legislation.
• However: • Engineer’s duty of care differs in different countries.
• Cases of collapse or other types of failure are rare • In Germany for example a consulting engineer may carry a
when qualified independent checkers are appointed. duty to ensure “fitness for purpose” whereas in the UK it
only extends to acting with “due care and diligence”.
• There are very few recorded cases of claims against
both parties. • So, make sure you check your liability!

Ferry Terminal Ramps, • Collapse 1994

Ramsgate, Kent • Design, fabrication and
construction had been checked
• Designers, checkers,
constructors, and owners all
• Checker’s role should not reduce the Designer’s liability,
charged under the UK Health
even when the Checker is providing expertise the Designer

may not have.
• Fines payable (excluding costs):
• Designer/builder: £1.0 M
• Checker: £0.5 M
• Client found to be most liable

CIRIA recommendation: “...the designation of an engineer to

appraise the design, operation and maintenance of the whole system.”
Why appoint an Independent Checker?

• Reduced risk of errors (mistakes)

Value for money
• Added confidence that the design basis is correct
• Reassurance that the design complies with the required
criteria and is likely to perform as expected
• Application of specific expertise
• Shared liability (additional professional indemnity insurance)
• Widen the knowledge base (shared experience = education)
• Peace of mind

If Checker’s scope includes Economic Design Review:

• Check for over-design as well as under-design

Conclusion
• Identify possible savings
• Changes must be agreed to and proposed by Designer
• Avoid confusing design responsibilities
• Only possible if the programme permits it
• More work, so the Checker’s fee is higher, but ...
• ... the Checker’s fee can be saved many times over!

• Structures are still failing.

• Are we becoming complacent and in danger of relaxing
our guard?

• Do the harsh lessons of the previous generation need to

Oscar Wilde • Systematic, competent, thorough checking is as vital

now as it has ever been.
• Many countries still have no established culture of
independent design checking.
• The cost of an independent design check is insignificant
compared to the value and added confidence it provides.
• Read the Merrison Committee of Inquiry report.
• Establish a full independent checking system.

the checker.
• For large projects (say >£100M) extend the Checker’s
scope to include an Economic Design Review.
• Allow enough time in the programme for a thorough
independent analysis and evaluation of the design.
• Designer and Checker interact in a spirit of mutual
respect and co-operation, learning from each other and
advancing the state of engineering technology.
