The undersigned is the assisting counsel of the private complainant
in the above-entitled case. While Section 5, Rule 110 of the 2000 Rules on Criminal Procedure mandates that all criminal actions commence by Complaint or Information shall be prosecuted under the direction and control of the prosecution, the same rule nonetheless authorizes a private prosecutor to handle such a case, subject to the approval of the court.
In this regard, may I humbly request your honorable office,
if you deem it fit and proper, to authorize in writing the undersigned counsel to prosecute the case up to its end, even in the absence of public prosecutor pursuant to Section 5, Rule 110 of the 2000 Rules on Criminal Procedure.
