DEED OF DONATION WITH ASSUMPTION OF MORTGAGE

KNOW ALL MEN BY THESE PRESENT:

This Deed of Donation (with Assumption of Mortgage) is being executed this


17th day of January, 2020 at Avocado Law Firm, Orange Building, JP Laurel, Davao
City by and between:

Ariana Vistar, Filipino, of legal age, single, and with residence at 77, Hope Street, Pag
Ibig Homes, Buhangin Davao City
hereinafter called the “DONOR”,

and

Antonette Lim, Filipino, of legal age, single, and with residence at 111, Cocacola
Village, Matina, Davao City,hereinafter called the “DONEE ”.

WITNESSETH:

WHEREAS, the DONOR is the registered owner of that certain real property,
situated in Mambago, Island Garden City of Samal and more particularly described in /
Transfer Certificate of Title No. 726262 of the Land Registry of Samal, as follows, to
wit:

TRANSFER CERTIFICATE TITLE NO. 726262

WHEREAS, the above described property is presently mortgaged in favor of BANK OF


THE PHILIPPINE ISLANDS to secure payment of an original obligation in the principal
sum of FIVE HUNDRED THOUSAND PESOS (P500,000.00), Philippine currency,
contracted by the DONOR from the afore-named mortgagee under the terms and
conditions set forth in the instrument of mortgage executed on March 24, 2018, before
Atty. Elden Claire Devilleres, Notary Public in and for Island Garden City of Samal, as
per Doc. No 34, Page No. 4.; Book No. 1 Series of 2018, of his notarial register, which
original mortgage obligation has been reduced to two hundred thousand
pesos(P200,000.00) , as of December, 2019.

NOW THEREFORE, for and in consideration of the love and affection which the
DONOR has for the DONEE, the said DONOR by these presents transfers and conveys,
by way of DONATION, unto the said DONEE, her heirs and assigns, the above-
described real property, free and clear of all liens and encumbrances except the
aforementioned mortgage subsisting in favor of ; BANK OF THE PHILIPPINE
ISLANDS and,

The DONOR does hereby state, for the purpose of giving full effect to this
donation, that she has reserved for herself in full ownership sufficient property to support
herself in a manner appropriate to her needs; and,

That the DONEE, with gratitude for the kindness and liberality of the DONOR,
does hereby accept this donation of the above – described real property and binds herself
to assume as she assumes the payment of the unpaid balance of the mortgage indebtness
of the DONOR amounting to TWO HUDRED THOUSAND PESOS (P200,000.00),
Philippine currency, in favor of the BANK OF THE PHILIPPINE ISLANDS by virtue of

the above-mentioned mortgage instrument executed on March 24, 2018 and does hereby
further agree to be bound by the precise terms and conditions contained therin.

ACKNOWLEDGEMENT
