JUDICIAL AFFIDAVIT

I, JAMES REID, 32 years old, Filipino, single and a resident of No.


21-A Pelaez Ext., Brgy. Sta. Cruz, Cebu City, after having been sworn to in
accordance with law and after having been examined by
Atty. Joshua Lao in Suite M-7, 2nd Floor, Rosary Ramos Street, Cebu
City, do hereby depose and state that:

PURPOSE: The testimony of the Witness is offered to prove the facts


and averments in the counter-affidavit of the accused. The Witness will also
testify on such other matters which are relevant to this case. The Witness
will also identify the document executed by him when the accused-
defendant was examined after the accident. Further, the Witness will also
identify such other documents that are relevant to this instant case.

Question No. 1 (“Q1”): Please be informed that this examination is under


oath and that you may face criminal liability for false testimony or perjury,
should you not tell the truth. Do you understand, Mister Witness?

Answer (“A”): Yes, sir. I understand.


Q2: Could you recall having executed a document in connection with this
case?

A: Yes, sir. I executed an ER blotter.

Q4: If this document will be presented to you, will you be able to identify
the same?

A: Yes, ma’am.

Q5: I have here a one (1)-page document dated March 15, 2019. Is this
document familiar to you?

A: Yes, ma’am. That is the document that I was referring to.

Q6: At the bottom of this document is a signature above the name JAMES
REID. Is this signature familiar to you?

A: Yes, ma’am. That is my signature.

Q7: Have you gone over and read the contents of the documents?

A: Yes, sir.

Q8: Do you affirm and confirm to the truthfulness and veracity of the
allegations contained in the document?

A: Yes, sir.

COUNSEL: May I request this Honorable Court that this document dated
February 15, 2019 which was identified and authenticated by this Witness be
marked as Exhibits “A”.

Q9: Mister Witness, do you know the person subject of this present case?

A: Yes, ma’am. NATHANIEL JORE, the accused.


Q10: Could you tell this Honorable Court how you came to know of the
accused?

A: Yes, ma’am. NATHANIEL JORE was brought to the ER of the Vicente


Sotto Memorial Hospital after being involved in an accident.

Q10: What then did you do?

A: Naturally, as per hospital protocol, I went to the patient and assessed his
physical condition and advised the ER nurse to dress his wounds.

Q11: What was the extent of his injuries?

A: I noticed some bruising on his body and a few abrasions common in


vehicular accidents. But no tell-tale signs of any injuries that needed
immediate attention.

Q12: What other findings where you able to gather upon your examination?

A: None.

Q13: Do you have proof, if any, of such a fact?

A: Yes Ma’am. We have a Medical Certificate issued by the attending


physician, Dr. James Reid, at the time of the aforementioned motor vehicle
accident which took place in February 2015.

I am executing this foregoing Judicial Affidavit to attest to the truth


and veracity of the allegations contained herein.

IN WITNESS WHEREOF, I have hereunto set my hand this 15th day

The affiant, whose name and personal circumstances are stated above,
personally appeared before me this 23rd day of October2017 in the City of
Cebu, Philippines, presented the foregoing Judicial Affidavit, signed the
same in my presence and affirmed under oath to the correctness of the
contents or allegations of the same.

The affiant was identified by competent evidence of identity, namely


a TIN 321-654-987 bearing his photograph and signature.
