AFFIDAVIT IN SUPPORT OF A COURT ORDER FOR AN,
ARREST WARRANT
Your affiant is Detective Jason Shatek, a duly commissioned deputy sheriff
employed by the Boulder County Sheriff's Office in the County of Boulder, State of
Colorado. Your affiant, being duly sworn and hereinafter referred to as “I”, deposes and
states the following
On September 19, 2016 at approximately 2000 hours, Boulder County Regional
Dispatch Center received a call of an assault at Lefthand Canyon Drive in the
unincorporated County of Boulder, State of Colorado. The caller was a neighbor who
resides at Lefthand Canyon Drive and he advised two individuals came to his
house and stated there was a pool of blood at the address of ' Lefthand Canyon
Drive due to an assault. These individuals identified the suspect as Jeffrey Collins
(06/29/00). The other two individuals were later identified as ( and
Dakota Montgomery ( )
Boulder County Sheriff's Office patrol deputies arrived at the reporting party's
address at 2042 hours where they met with medical personnel who were already on
scene assessing the condition of the victim, who had been moved there. The victim
was later identified as Kathrin Kulpa ( Deputies cleared the residence where
the victim resides, which did not have numbers on the house or an associated mailbox.
Deputy Michael Chickos, a duly commissioned deputy sheriff employed by the Boulder
County Sheriff's Office in the County of Boulder, State of Colorado explained blood was
present in the bedroom of the residence as well as outside the residence.

Page fof 11Deputy Chickos and Deputy Kirk Schneider, both duly commissioned deputy
sheriffs employed by the Boulder County Sheriff's Office in the County of Boulder, State
of Colorado, later conducted brief interviews of and Montgomery and they
explained the following:
Collins, Montgomery and camped overnight from September 18, 2016 to
September 19, 2016 in the foothills in the County of Boulder, State of Colorado. During
which time Montgomery admitted to using heroin. They planned on being picked up by
one of Collin’s friends on September 19, 2016, the same friend that drove them up to go
camping and left, but he never came to pick them up. They then hitchhiked to the area
of Ward and were shortly thereafter contacted by Kulpa while they were standing on the
side of the road hitchhiking. They told Kulpa they were trying to get to the Boulder area
and Kulpa offered to give them a ride to her residence, which would be closer to
Boulder and further down the canyon. When they got to her house, they stayed there
for approximately two hours before Collins assaulted Kulpa. They were outside hanging
‘out by the fire pit for the majority of the time.
Kulpa assisted Collins with trying to get in contact with his grandpa so they could
be picked up, but Collins was unable to get in touch with him. Kulpa offered to let them
stay at her residence. She went inside of her residence and made space for the three
to stay. During this time, Collins asked Montgomery to help him assault Kulpa so they
could steal her car. Montgomery declines to help. Kulpa then went back outside to let
them know there was space. She then turned away from Collins. Collins then hit Kulpa
from behind in the head with a stick which was designed to be used as a “fire poker.” It
was described as a wooden stick with metal on one end of it,
Montgomery explained seeing Collins, “take a full swing, one where Jeffrey
[Collins] put a lot of force and effort into the swing” with the fire poker when he struck
Kulpa on the head. Montgomery and then began running from the residence. They
went to two homes before someone answered and they were able to find a house with a
phone to have someone call 911 for help. While running from the residence, they saw

Page 2of 1Collins get into a white hatchback, which was driving on Lefthand Canyon. Collins then
left the area
Detective Jeff Pelletier, a duly commissioned deputy sheriff employed by the
Boulder County Sheriff's Office in the County of Boulder, State of Colorado was called
to assist with the investigation. At approximately 2159 hours, Detective Pelletier arrived
at Boulder Community Hospital to meet with Deputy Doug Woodard, a duly
commissioned deputy sheriff employed by the Boulder County Sheriff's Office in the
County of Boulder, State of Colorado. Detective Pelletier was able to see Kulpa as she
was being treated in the emergency room. He described that Kulpa had a laceration on
the right side of her head. Her right eye was swollen shut with bruising and there was
another large laceration above her right eye. Pictures was taken, please see
Attachments A and B.
Dr. Stephen Johs later came into the treatment room and explained Kulpa also
had a skull fracture from the injuries sustained. Dr. Johs also signed a Boulder County
Sheriffs Office serious bodily injury form, where he checked off that Kulpa's injuries
involved_a. substantial risk of—death, a substantial risk of serious permanent
disfigurement and a substantial risk of protracted loss or impairment of the function of
any part or organ of the body, specifically visual loss. This was based on Dr. Johs
directed examination and review of imaging from Kulpa. The injuries of note were listed
on the form by the doctor as a skull fracture and subarachnoid hemorrhage.
Deputy Woodard heard a brief statement of the incident provided by Kulpa while
at the hospital. Deputy Woodard said Kulpa initially could not remember anything from
the incident, but began speaking about it while they were at the hospital. Kulpa said
she gave three males and one female a ride in her car, to her residence. Once at her
residence, she told them they could stay at her house until they could figure something
out or could get a ride to their homes. Kulpa said that Collins’ belongings were still
inside of her vehicle which was parked on Lefthand Canyon Drive near her residence.

Page 3f 11Kulpa then said she was in too much pain to talk and that concluded the statement
Deputy Woodard obtained from Kulpa.
While at the hospital, Detective Pelletier was also able to ‘speak with Kathrin's
‘son, Kurt Leverentz ( '). Leverentz said Kulpa lives “off the grid". She lives in a
cabin which does not have a phone line and he’s been trying to get this setup for her in
the residence. Leverentz said Kulpa will at times do things such as pick up hitchhikers
0r do “good things” for people without realizing the risks associated with her behavior.
Since deputies cleared the residence where the incident occurred, deputies have
been present securing the residence as well as Kulpa's vehicle awaiting the arrival of a
search warrant. Kulpa’s vehicle was a green 1997 Subaru station wagon, bearing
Colorado license plate 265SHU. According to the vehicle registration in CCIC, Kathrin’s
actual address is ' Lefthand Canyon Drive.
After the search warrant was signed, we then searched Kulpa's car and
Processed the crime scene. Located in a wine box in Kulpa's vehicle was a letter from
the Department of Revenue. It was addressed to Jeffrey Collins, date of birth, 100.
It stated that his license had been cancelled / denied. Also present in the car was a
partial tent and some hygiene items.
We then walked to the crime scene located at Lefthand Canyon Drive,
Boulder County, Colorado. | walked to the Southside of the road and crossed a small
bridge. | observed a small cabin that could best be described as dilapidated and a
small meadow. The small meadow contained several stacks of firewood, a fire ring,
numerous chairs, a stack of axes, and other equipment used to live in the woods. Near
the fire ring, | observed several pools of blood. There was enough blood that it had

sitting next to it. The stick had a metal sheath over the end that was screwed on. |
could see a large amount of hair and some blood on the metal sheath. The stick was

Page 40f 17broken right at the end of the metal sheath. It is unknown where the rest of the stick
went. This appeared to be the weapon that had struck Kulpa. | also observed the inside
of the cabin. There was a large amount of blood in the upstairs area
On 9/22/16, at approximately 2015 hours, Jeffrey Collins was arrested in
Broomfield, Colorado. He was transported to the Boulder County Sherif’s Office and
interviewed. Present during the entire interview was his legal guardian Christine
Atzenbeck, date of birth, | began by advising Collins and Atzenbeck of his
Miranda Rights. Collins and Atzenbeck both filled out the Advisement of Rights. Collins
checked each of the statements and stated that he understood his rights, and that he
wished to speak with us. The interview was recorded.
| asked Collins what had happened and he told me the following: On Sunday,
9/18/16, Collins, Dakota Montgomery and went camping near Ward. They
had gotten a ride from, "Kyle", unknown last name and date of birth. He said when they
went camping, they had gone past Ward and it was approximately 5:00 p.m. He did not
know the exact location or even an approximate one. They camped for one night from
9/18/16 to 9/19/16, After they camped, Kyle could not find his way back to pick them
up, so they hitchhiked to Ward, CO. Collins stated that he had a tent, but it was not a
full one, | noted at the time this was consistent with the partial tent we had found in
Kulpa's vehicle. Collins went on to say that a lady (Kulpa) had picked them up in Ward,
Colorado, he did not know her name. He didn’t know what time it was, but before 2:00
P.m on 9/19/16. He said that he had called his grandfather, and he couldn't find a ride.
‘She had then offered to give them a ride to her house and they accepted. Collins then
stated, "She gave me a lot of alcohol and | was stoned as hell.”
Collins went on to say that he, Dakota, and had all gone down with the
victim, Katie Kulpa to her residence at Lefthand Canyon Drive, Boulder County,
Colorado. Kulpa took them there in her vehicle because they didn't have anywhere else
to go and they couldn't find a ride. It would also put them closer to their destination as
they were trying to get to Boulder. Collins said she asked if they wanted to drink beer

Page 5 of 17and smoke marijuana, and they accepted. He said they hung out by the campfire. He
said it lasted a couple of hours. Kulpa then told Dakota to drive Collins up to Ward to
call his grandfather again. Dakota then attempted to drive Kulpa's vehicle, but he didn't
know how to drive a stick shift. He could not get the car to go and ended up grinding
the gears. Kulpa then came up to the road and yelled at Dakota. She was upset
because they were wrecking her car. Kulpa then gave Collins a ride back to Ward while
Dakota and stayed at her residence. From Ward, he called his grandfather, but
he could not get a hold of him. His grandfather did not answer. Kulpa does not have a
Phone and cell phones do not work. Collins said that when they returned, Kulpa went
down and spoke with
At that time, Dakota was by the road and spoke to Collins. Dakota stated
specifically, "Hey dude, we should do this." He also stated, "Come on man, follow
through with it" | asked specifically what Dakota had said and Collins stated, "Let's kill
her and take her car." Collins said Dakota wanted him to use an ax and he pointed out
four or five axes. Collins stated that he had used a "blunt object". | asked him if it was
a stick and he said, "Yeah." He said that after he grabbed the stick, he didn't remember
what happened and only saw her on the ground. Once he saw her on the ground, he
thought "Oh fuck." He went on to say that he was really, really drunk. He said that he
then ran with and Dakota toward the road. When he got to the bridge, Dakota
told him to go back and get the keys. He started to go back but then saw and
Dakota grab their stuff out of Kulpa’s vehicle. He then went toward the vehicle. He said
they locked the vehicle. He said that he could not get his stuff out. | then asked Collins
on a sale of 1 to 10, how hard he hit Kulpa and he said, "A 6 or something, I wanted to
knock her out." He went on to state that he didn't want to kill her. Collins then stated
that the plan was for him to hit her initially and then Dakota would start beating her.
However, he said Dakota and took off running. | then asked what happened next
and Collins said that he ran to Ward, He later changed his story and said he had gotten
a ride. He said that he then called his grandfather, Dabney Collins, date of birth,
and waited two hours. He said that his grandpa then took him back to his
house in Arvada and they arrived at approximately 10:00pm on 9/19/16. He then took a

Page 6of 11shower and went to bed. | then asked about his clothes and at first he stated that he
had no idea. However, when | asked if he left them at his grandfather's, he said yes.
Collins clothes were later collected. Collins again stated that he was "drunk as hell."
He said that he had not drunk in a long time.
Collins went on to state that Kulpa had been feeling him up. She was feeling up
his shirt and making him uncomfortable. He stated, "She was hitting on me really hard."
| then asked how much he had drank and he said five or six beers. He stated that he
drank three beers right away and then sipped on the others. He said this occurred over
@ two to three hour period. He said that he had not drank in three or four months, and
he had not had anything to eat. He reiterated that he was "stupid drunk, stumbling, and
could barely stand.” Collins then spontaneously stated, "I shouldn't have done it
anyway.” | then asked Collins if he thought she was dead and he said, “I did think she
was dead.”
| then asked where Collins had hit Kulpa and he said, "in the head." He said that
when she fell down, she was lying on her left side. I confirmed that he had not hit her in
the front and he stated that he didn't think so. He went on to say that he was pretty sure
he had only hit her once. However, he had no idea. He said he thought there was only
cne injury. 1 then showed Collins two pictures of the victim's injuries. Collins stated that
he may have hit her in the front of the head. He said that the injury to the front of her
head was consistent with the blunt object he had used. He went on to say that he heard
her hit the ground. Collins then admitted that he had done it and while doing so,
gestured with his hands like he was swinging a baseball bat from over his head and
down. During my interview with Collins, he never denied hitting Kulpa with the fire
poker.
Collins stated several times that he only hit Kulpa once. However, Kulpa
sustained two very serious injuries to her head resulting in cranial fractures. Collins
said she may have hit her head when she fell down. | noted at the crime scene that the

Page Tf 11fire pit rocks were a few feet from the blood pattern. | did not see any blood on the fire
ring or any adjacent rocks. Collins later admitted he may have hit her more than once.
| then told Collins that Dakota and had said it was his idea. Collins went
on to say, "That's not true, that's how I got framed, Dakota was involved.” Collins went
on to say that they were girlfriend and boyfriend and that it was two against one. Collins
was adamant that Dakota should get in trouble for this as well, | asked Collins why
Dakota would want to hurt Kulpa and Dakota had told Collins, "She's a bitch, we could
just kill her." | asked why Dakota would have been so mad, and Collins claimed it was
because Kulpa had yelled at him for grinding her clutch and wrecking her car. During
that time, Kulpa had confronted Dakota and stated, "What the fuck are you doing to my
car?"
During the course of the interview, Collins also described the fire poker. He said
that it was a stick with a piece of metal on the end of it, but he didn't know how long it
was. He described that it was a stick with a metal sheath over it. | noted his description
of the weapon was consistent with the metal part of the weapon we recovered on scene
and placed into evidence. | also noted that , Dakota, and Collins’ stories were
consistent except for whose idea it was to attack Kulpa
Collins was arrested as a juvenile with a juvenile docket assignment. However,
after the district attomey's office reviewed the case they decided to charge Collins as an
adult. This warrant was updated and completed so Collins could be processed as an
adult
WHEREAS, your affiant believes sufficient probable cause has been
demonstrated to believe the crimes of Attempted Murder in the First Degree, contrary to
CRS. 18-3-102(1)(a)(d) and Assault in the First Degree of an At-Risk Adult contrary to
CRS. 18-6.5-103(3)(a) have been committed within the Unincorporated County of
Boulder, State of Colorado.
