Plaintiff Christin Ambrocia Myles ("Myles"), for her Complaint against Defendant
Brandon Marshall ("Marshall"), alleges as follows:

PARTIES. JURISDICTION AND VENUE

Myles is a woman residing in the State of California.

Upon information and belief, Marshall is a man residing in Southwest Ranches,

Florida.

Jurisdiction is proper in this Court pursuant to 28 U.S.C. 1332, because Myles


and Marshall are citizens of different States and the matter in controversy exceeds

the sum or value of $75,000.

GENERAL ALLEGATIONS

Myles is a victim of assault and battery by the intentional actions of Marshall


outside of Marquee nightclub in Manhattan, New York on March 11 th, 2012.

Marshall struck Myles in the face outside of Marquee nightclub.

There are eyewitness accounts to attest to the fact that Marshall struck Myles in

the face.

There is evidence in the form of a videotape that proves Marshall struck Myles in

the face outside of Marquee nightclub.

Marshall violently sent the 140 pound women (Myles) to the ground.

The strike delivered by the six foot four inches tall, 230 pound NFL player

The strike by Marshall caused Myles extreme reoccurring head and neck pain.

As a result of the strike from Marshall, Myles suffered severe headaches and

developed an abnormal intolerance to the visual perception of light, a condition

16

known as photophobia.

As a result of the strike from Marshall, Myles suffered the visual displacement of

single objects horizontally, vertically, and diagonally in her visual field, a

20

condition is known as diplopia.

As a result of the strike from Marshall, Myles saw a doctor for possible treatment

23

and reconstructive surgery to correct a small lid laceration, ecchymosis,

24

temporal/inferior subconjuctival hemmorage, and a discoloration of the skin from

25

ruptured blood vessels around the tender parts ofthe eye cavity, identified as

26

upper lid chemosis.

and/or has acted so recklessly with respect to Myles' rights, that an award
of punitive damages is appropriate.

INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS

Myles incorporates by reference all prior Paragraphs of this Complaint.

Marshalls actions constitute extreme and outrageous conduct that has the intentio
of causing, or that recklessly disregards the probability of causing, emotional
distress to Myles.

Myles, in fact, has suffered severe or extreme emotional distress as a direct


and proximate result of Marshall's outrageous conduct.

Marshall has acted with such malice, hatred, and ill will toward Myles,
and/or has acted so recklessly with respect to Myles' rights, that an award
of punitive damages is appropriate.

PRAYER FOR RELIEF

WHEREFORE, Myles prays that judgment be entered against Marshall as


follows:

A. That the Court award Myles her actual damages sustained as a result of Marshall's unlawful
conduct, in an amount to be decided at trial but which amount shall exceed $75,000.00, plus pre
judgment and post-judgment interest thereon, at the legal rate, until paid in full;

B. That the Court award punitive damages to Myles in an amount to be decided at trial.

C. That the Court award Myles her reasonable research strategist fees and expenses accrued and
accruing herein, plus post-judgment interest thereon, at the legal rate, from the date judgment is
entered until paid in full;

D. That the Court award Myles her taxable and non-taxable costs accrued and accruing herein,
plus post-judgment interest thereon, at the legal rate, from the date judgment is entered until paid
in full; and

E. For such other forms of relief as the Court deems just and proper.
