ESMA's RTS 22 Consultation Paper: Key Changes & Implications

On October 3, 2024, the European Securities and Markets Authority (ESMA) released a consultation paper addressing proposed amendments to Regulatory Technical Standards (RTS) 22 and RTS 24 under the Markets in Financial Instruments Regulation (MiFIR).  This review responds to mandates from the European Commission to align technical standards with updates to Articles 25 and 26 of MiFIR. Read more.

Rule 13f-2 and Form SHO Reporting Obligations for 2025

As the SEC’s new Rule 13f-2 comes into effect in January 2025, investment managers need to prepare for the increased complexity of managing and reporting their short positions via Form SHO. The Rule requires institutional investment managers to report gross short positions on a monthly basis, aligning with the broader SEC efforts to increase transparency in the markets. DP24/2 Review: FCA's Vision for UK's Transaction Reporting Regime

The FCA has released Discussion Paper DP24/2, setting out proposals for revising the UK’s transaction reporting regime. While the FCA emphasises that the current framework is effective in detecting market abuse, it also acknowledges the need for updates to reflect evolving market conditions and changing data requirements since the implementation of MiFID II in 2018.
