The new law decree no. 227/2023 has been published in the Official Journal on February 5, 2024. The new decree regards the yachting professional qualifications for seafarers embarked on pleasure vessels carrying out chartering activities and on other vessels carrying out chartering activities for touristic purposes. In particular, the law decree no. 227/2023 regulates: 1) The so-called “STWC Qualifications” in compliance with the 1978 International Convention on Standards of Training, Certification and Watchkeeping for Seafarers. It modifies the qualification requirements with reference to the tonnage of the vessel; 2) the second-class national qualifications (not STWC) of Yacht Officers; 3) the introduction of a special qualification for sailing vessels. With regard to STWC Qualifications, the Yacht Officer shall be trained in compliance with the relevant international conventions. The Professional Yachting Association (PYA) and the Italian Yacht Masters Association (IYM) are sounding the alarm on a hidden danger: a surge in unqualified crew with fake or purchased licenses, which raises potential safety issues for crew, passengers, and vessels. They also advise that it is in the best personal interests of all crew not to waste money on any Certificate of Compliance ('CoC') which is not recognised by the major Flag states in yachting. The same principle applies to any type of training course (deck, engineering or interior) which is not accredited by the rigorous requirements of national educational establishments, or the industry-driven GUEST-audited courses. While there are procedures in place to identify fraudulent licenses - Flag states such as MCA (Maritime and Coastguard Agency) and TM (Transport Malta) can denounce any fraudulent tickets they encounter - there are still loopholes. The International Maritime Organization (IMO) maintains a "White List" of countries that meet strict minimum training and certification standards for seafarers (STCW). Holders of a CoC from a non-white list country will most likely be denied a Certificate of Equivalency, they will likely be rejected as a viable manning solution for white list flagged vessels, and their sea time and training may either be highly scrutinised or not accepted at all towards a CoC from a white list country. The PYA and IYM urge all yacht crew, managers, recruiters, and insurers to only accept white list CoCs to ensure the safety and legitimacy of their yachting operation. Not everything can be a fast process. Especially when yachts say they need a Captain ASAP. While filling this type of role is achievable, You'll be heavily relying on fate - if the stars align and the timing is right, you MAY get yourself an amazing Captain who has suddenly become available. However, in most situations, there are some major issues with a rush placement for a Captain… 1. You won't get the best of the best because most of the great Captains will be employed and will need to give adequate notice to leave on good terms 2. You'll end up going for whoever is available even though they may not be the right fit for you and vice versa 3. Increased risk of poor longevity as they may not stay onboard as long as you'd hoped 4. Minimises the opportunity for a decent handover which helps Captains to hit the ground running Captains are integral to the smooth running of a yacht, and the recruitment process can and should be a more involved process than with other crew members. I've been using some of my recent down time to write a host of new articles for the SYR - Shoreside Superyacht Recruitment wesbite and future newsletters and one of the pieces I've written focusses on why a certain area of jobseeker would choose to work in yachting/marine/superyacht over other industries such as automotive, aerospace or other luxury sectors. It was an interesting exercise in pinpointing the great and the good about our industry and I thought it'd be a great exercise to roll this out to my network. The threat of piracy around the Gulf of Aden has long been a concern: British cruisers Paul and Rachel Chandler were famously kidnapped — and held for over a year before their safe release– by Somali pirates in 2009. Although the danger posed by Somali pirates has lessened considerably since attacks peaked between 2000-2011, more recent attacks by Houthi rebels in Yemen on Red Sea cargo ships with apparent links to the US, UK and Israel have once again made the situation high risk, with activity escalating since the end of 2023. Yacht owners heading to Europe westbound from Asia have two sailing options: to double the Cape of Good Hope, or to pass through the Suez Canal (the alternative is to have their yacht transported). Billion-dollar shipping companies with cargo vessels of hundreds of thousands of deadweight tonnes have opted for the former to avoid the dangers of the Bab-el-Mandeb Strait at the entrance to the Red Sea. The equation is different for small yachts. Reasons to transit the Suez Canal At the outset of their four or five-year circumnavigation, Greetje Tops, co-owner of the 33ft Dutch-registered Bermudan sloop Black Moon, envisaged she and her partner Niels would return to the Netherlands via Suez. News of the Houthi attacks reached them in Indonesia. A long route via Cape Town would have meant staying longer in Asia to prepare. But refitting the boat and an additional year of travelling would come with a price. It would be a long time to live on what Tops describes as a small boat. Did they really have time to go round the Cape – or should they continue with their original planned route? “Basically we followed our gut feeling,” explains Tops. “Everyone was saying you can’t cross at this moment. When we started [cruising] everyone said Covid was too dangerous. Let’s find out for ourselves.” An estimated 50-60 yachts crossed the Suez Canal in 2023 and 2024, down from a peak of 75 in 2019. Despite unfavourable winds delaying their total passage time to nearly six weeks from Djibouti, after five stopovers in Sudan and six in Egypt, they arrived safely in Europe in mid-May. The crucial piece of advice they say for planning a Suez transit is to prepare as far in advance as possible.
