🆕 Three new published opinions on the fiduciary duty between spouses, injunctions against harassment, and child support: 𝐒𝐤𝐨𝐠𝐥𝐮𝐧𝐝 𝐯. 𝐁𝐚𝐫𝐛𝐞𝐫: When a spouse transfers community property in a business, courts must evaluate whether the transfer was legitimate and benefitted the community. A transfer is not automatically a breach if it serves a valid business purpose. 𝐌𝐚𝐫𝐭𝐢𝐧𝐞𝐳 𝐯. Delinquency at a property is like a weed. If you don't fix it ASAP, it can spread like crazy and stay for awhile. It is overwhelming, but with the correct structures in place, you can solve it. For example, after buying a property, we inherited over $200K of delinquency, but we came prepared: 1. During the first 30 days of takeover, we reached out to each resident and gave them a chance to pay. This bought some goodwill. 2. We prioritized the highest balances and if they did not communicate with us or pay by the deadline, we filed for eviction. 3. We implemented strict rules and procedures and retrained residents on the need to pay on time. Essentially, there's a new sheriff in town. 4. It took 6 months of follow-up and consistency (emails, phone calls, texts, and knocking on doors) that by month 7, our delinquency was $.03 and we all had a good laugh about it. 5. Rent collection has regularly been 97-98% each month since then on a 300+ unit property. What have you done to combat this at your properties? Share below!

If you’re worried about an asset (like a second home, savings account, etc.) not being protected because YOU FORGOT to add it to your trust later on… Enter: the pour-over will. This is the catch-all of wills. And it’s popular for a good reason. 👉 All a pour-over will does is that it makes sure everything gets put into the same trust, EVEN IF you miss something. Example: 1️⃣ You open a trust and transfer all of your assets into it. 2️⃣ Then you buy a second home, but forget to add it. 3️⃣ If you pass away before adding it, then the personal representative of your will is able to put the second home back into your trust. 4️⃣ Then, the trustee that you picked can follow your instructions on that second house.
