💭 Can reliability and generative AI go together? 📅 On March 29, King County Superior Court Judge Leroy McCullogh in Washington state issued what experts say is a novel ruling barring the use of videos enhanced by #AI as evidence. 💡 The Washington ruling is a first in the U.S.—and one that the forensics community says was a long time coming. While #forensic experts have always had to demonstrate that #evidence introduced into courts was reliable, judges haven’t always enforced this requirement evenly. In cases that now involve black box technologies like generative AI, the concept of reliability may become more difficult, if not impossible, to prove. “On the one hand, you have new technologies that are coming into investigations, into court, and on the other hand, we have the new Rule 702 amended to underscore just how important it is that judges be vigilant about the reliability of expert evidence,” Brandon Garrett, L. Neil Williams, Jr. Professor of Law and director of the Wilson Center for Science and Justice at Duke Law, told Legaltech News. “Those two things coming together may result in a lot of really interesting learnings over the years to come.” My latest for Legaltech News:

I'm not surprised to see this ban on AI-enhanced video evidence. We at Alitigate LLC have used just about every tool out there to experiment with AI in our legal video and trial support workflows. You've likely come across tools designed for upscaling photos or videos, and while these tools can produce visually stunning results, the devil lies in the details of how AI visual enhancement technically functions. AI image and video generators use a diffusion model to create their output. This means that AI essentially redraws your picture or video from memory, pixel-by-pixel. This process generates entirely new pixels for every single pixel in the original picture or video. Although that's great for entertainment, it presents significant challenges when using such AI-enhanced videos as evidence in legal proceedings. As AI technology continues to integrate with the legal sector, we legal professionals must carefully consider the implications of admitting AI-generated content as evidence. In the coming years, we'll see a lot of movement in this space as guidelines emerge to ensure the integrity of the justice system in the wake of AI proliferation.
