The #EDPB have issued a statement recommending that DPAs be appointed as Market Surveillance Authorities (MSAs) for high-risk #AI systems under the EU's AI Act. The AI Act itself already contemplates this possibility, but only for high-risk AI systems used for law enforcement, border management, administration of justice and democratic processes. The EDPB also recommends DPAs be appointed the MSA for other high-risk AI systems, particularly (but not only) where there is a data protection angle. This would be a very significant expansion in power the DPAs - not only increasing their fining power (7% of turnover), but also their material scope beyond personal data processing.
