Charities - the set and forget myth No doubt all persons responsible for charities (board, management etc) are aware that there is an ongoing obligation to review the governance and operations of the charity to ensure it remains eligible to be registered with the Australian Charities and Not-for-profits Commission. For those that need a refresher or are looking for a way to document this, the ACNC has a self evaluation form that can be completed and signed by the board. It's a good way to meet your obligations... but ultimately ensuring all responsible people are invested and across the activities of the charity is an even better outcome. In my own experience, many charities were not fully aware of/familiar with the Notifiable Events regime, so this is probably a welcome change. There had been some suggestions, as part of charity law reform, that the obligation to report should be placed on a statutory footing (but this did not come to pass). I will drill into this further in due course, but in the meantime, charities who are facing issues which would previously have been classed as "notifiable events" can now take some comfort that if appropriate mitigating steps have been taken, lessons learned etc with no ongoing issue, that they do not need to self-report. #thirdsector #charitylaw #charitylawyer
We are no longer asking charities to use our Notifiable Events process to inform us when something serious has happened to the charity. It is the responsibility of the charity trustees to manage their charity effectively and handle issues or significant events as they arise. If an issue has been dealt with effectively and the problem has been resolved, there’s no need to notify OSCR. If, however, it is not possible to address any serious issues, or if these issues have not been dealt with in a satisfactory way, charities and trustees should report this to us through our raise a concern form.
