🌍 The EU's GPSR (not to be confused with GSPR for #medtech and #ivd enthusiasts) is now in force as of last Friday! #Medicines are out of scope, but #medicaldevices are partially covered. Not all EU regulation is digital regulation - there is also product safety, and of course those rules apply regardless of where a company is based, as long as it puts products onto the European market. With the commencement of the EU General Product Safety Regulation only a few short weeks away, it was important to hear the insights from the European Commission team on the real-world implications of the new rules, here at the Commission’s International Product Safety Week in Brussels. Valuable reminders from Kristyna Deiberova and András Zsigmond from DG JUST, the team responsible for the new Regulation, Christophe Roeland from DG GROW providing a broader perspective on the interaction between GPSR and other EU product regulations, and Bernice Farrugia from the Maltese Competition and Consumer Affairs authority providing a perspective from a Market Surveillance Authority. The GPSR is an major piece of legislation that is introducing new obligations for manufacturers, suppliers, retailers and online marketplaces, including those based overseas but whose products are marketed to EU consumers. 📅 It's today - 13 December 2024 - when the #GPSR (EU #GeneralProductSafetyRegulation) starts to apply! Businesses (producers, importers, distributors but also online marketplace providers) had 18 months since its entry into force to prepare for this day. When I look back, I see a year full of work 🎯. Since the beginning of 2024, we have been intensively helping our Clients to implement the GPSR requirements. We were also sending legal alerts, posting up-dates on our blog KRK Product Law, giving presentations, organising webinars for industry associations and explaning the upcoming changes in the media. The International Product Safety Week (#IPSW2024) organised by the European Commission combined with the ICPHSO (Intl Consumer Product Health & Safety Organization) in Brussels in October was a highlight and the best opportunity for exchanging opinions on the interpretation of the GPSR. It showed i.a. that the new legal order for product safety means a lot of work for the European Commission and national regulators (including Urząd Ochrony Konkurencji i Konsumentów), too. ‼️ Now, we are starting a new chapter entitled "Living with the GPSR". I am confident that it's going to be interesting and challenging. A lot of issues will have to be solved in a new, GPSR-compliant way. We must be ready for this challenge in the EU. Along with the new #ProductLiabilityDirective and the EU #CyberresilianceAct (both recently adopted and published in the EU Official Journal in November 2024), the GPSR is an element of a complex EU legislative initiative with the aim to enhance consumer protection in the new technologies' era. #ProductSafety #cyberresilience #newtechnologies
