Before diving into the specifics of water use permits, it's essential to determine if you need one. Throughout Florida, you generally do not need a water use permit for the following: 🟡Domestic Water Use: Single-family dwelling or duplex with a single withdrawal facility. 🟡Firefighting Water Wells: Exempt under 40E-2.051, F.A.C. 🟡Single Family/Duplex Landscape Irrigation: Includes home lawn and ornamental irrigation, car washing, etc., covered under 40E-2.061, F.A.C. as a Permit by Rule. 🟡Short-Term Dewatering: Includes well-pointing or utility construction under specific conditions (e.g., max daily pumpage of less than 5 MG). 🟡Closed-Loop Systems: For cooling/heating systems with withdrawal and discharge points on the same property and other conditions. 🟡Salt Water and Reclaimed Water Use: In a lined pond not supplemented with groundwater or surface water. 🟡Livestock Drinking Water: From a pond or surface water not supplemented with a well or pump. A water use permit is required for other activities, such as irrigating a golf course, watering livestock with a well, or withdrawing water for industrial use. More case law to get our heads around!! Very brief details: Environment Canterbury have had a consent for an irrigation scheme quashed after a JR was brought by the Environmental Law Initiative. Bear with me.... Judge Newhook helpfully provided the audience with plausible consenting scenarios and left us with some questions to consider, mostly around the process that is set out in the Bill. One that he brought up is the proposition of 'who' could/should be considered 'adjacent' when deciding who should be invited to comment on an application. One that I have taken away is what if the activity is occurring on land where the downstream effects occur/impact on land that may not be physically adjacent, but because of the flow of water, could be considered 'adjacent' in the broader physical sense?? Independent public scrutiny of proposed laws is needed to counter the private interests which seek private benefit, who as this case demonstrates, are not concerned with protecting the taonga that is our environment and on which we all rely. Section 107 of the Resource Management Act places limits on councils’ power to permit water pollution. Last week, the Government's planned weakening of s107 got one step closer last week with the Primary Production Select Committee's report on the Resource Management (Freshwater and Other Matters) Amendment Bill. The Government first announced its intention to amend s107 in August, after a short campaign by agricultural industry lobbyists. The lobbying followed ELI’s success earlier in the year in the High Court in overturning Environment Canterbury’s decision to grant a discharge consent to Ashburton Lyndhurst Irrigation Ltd. ELI’s successful judicial review should have been a turning point that prevented waterways being degraded even further in Canterbury, but instead, the Government has caved in to the demands of the industry. The process followed by the Government means that there will be no opportunity for ELI, or any other member of the public to have their say on the changes which cut to the heart of Aotearoa’s freshwater protections. “Along with the other changes in this Bill, the Government is eroding protections for freshwater and exacerbating the freshwater crisis” says Ms Sintenie. #freshwater #nitrates #agriculture #rivers Read the full piece at the link:

In California today, we have given unelected state bureaucrats the power to make decisions that affect millions of people and cost billions of dollars, and there is almost no recourse. There is also very little public criticism of the decisions these agencies make. That’s because the people who are most familiar with the extraordinary power of these agencies are also the people who must go to them for permits and, often, critical funding. Despite the absence of meaningful public criticism, the primary narratives that state agencies use to decide water policy in California are highly debatable. Beyond water volume, is the issue of water quality. The public does not appreciate the extent to which we've polluted the system, to render large areas of it ecologically dysfunctional, driving species eradication. Great gains could be made ecologically, if policy focused more on changing land-use to become compatible with making clean water in the river, rather than a eutrophic, pesticide, wastewater gutter. Adding more polluted water, won't solve a pollution issue. The Murray Darling has a pollution issue.

New open access paper just published on the Australian public's preferences for further environmental and cultural water recovery options in the Murray-Darling Basin. Key Points: 1) There is strong willingness by the public (with 60% in agreement) for further water recovery beyond current goals, and especially for additional environmental and cultural water recovery. 2) The main individual method for water recovery favoured by a third (33%) of the public was irrigation infrastructure subsidies and supply projects, however the majority (56%) favoured two market approaches of a) buying water entitlements from willing sellers or b) compulsory funded acquisition (at current market prices) of a certain percentage of all water entitlements. #murray-darling basin #water #buyback #irrigation infrastructure #water recovery https://lnkd.in/gwAUfmDn
