🔎 MYTH: The SRA prescribes exactly what counts as QWE 🔎 Wrong! 🚫 Welcome to instalment #2 of QWEnsday – where I break down the QWE myths for aspiring solicitors qualifying with SQE 🤔 📣The SRA has said repeatedly that “it cannot prescribe what exactly counts as QWE”. 🎗️This is in recognition of the wide variety of work across organisations that counts as the provision of legal services ⚖️ ▶️Instead, the SRA refers you to the legislated definition of “legal services” and the act that also determines who is an authorised person: The Legal Services Act 2007 📜 It’s a long act, BUT worthwhile reading for aspiring lawyers of England & Wales to properly understand what authorised persons & reserved legal activities are and who can and cannot undertake them (I’ll do a post unpacking this in coming weeks too). 🔎 Let’s look at the section the SRA advises you refer to specifically: (s. 12) defines legal activity and can help candidates decide whether their role involves delivering legal services. On initial glance, the act looks restrictive as it appears to be referring to reserved legal activities only. 🧐However, as with most legislation, the sentences used are longer than we use in normal day-to-day English and must be unpacked (side note, one can often tell someone has written to many legal essays by the super long sentences they use, me included, a hard habit to shake!) Let’s unpack section 12: b) **any other activity** which consists of one or both of the following— (i) the provision of legal advice **or assistance in connection with the application of the law or with any form of resolution of legal disputes**; (ii) **the provision of representation in connection with any matter concerning the application of the law or any form of resolution of legal disputes** 🚦[Section (a) refers to reserved legal activities (which only authorised persons can conduct, i.e. a solicitor, licensed conveyancer, probate practitioner or CILEX with practice rights notary & some accountants).] ▶️ But section (b) refers to **any other activity** not just reserved activities. So – 🚨 QWE is not limited to only the reserved activities! 🚨 At our Access Law Clinic we see a wide range of work that qualifies including in-house counsel and court work.
