In another major US Supreme Court decision today affecting the aviation industry, Loper Bright Enterprises v. Raimondo significantly curtailed the power of federal agencies to unilaterally interpret the laws that they administer. The Court discarded the landmark 40-year-old Chevron doctrine, which required courts to defer to a federal agency’s reasonable interpretation of an ambiguous or unclear statute or regulation. Raimondo now requires that courts “decide legal questions by applying their own judgment” and clarifies that “agency interpretations of statutes … are not entitled to deference.” A massive sea change concerning the FAA’s interpretation of its own laws is possible on matters including enforcement actions (particularly FAA versus NTSB sanction determinations), certification, airport grant assurances and other compliance issues, airspace and zoning decisions, etc. The full opinion can be found at: https://lnkd.in/eQ4vjV_X #NavigatingtheWay #AviationNews #FAA #LOPAL #LawOfficesofPaulALange #Chevron #Raimondo
