The thing I would like. Everyone can take away from this advantage. You probably heard you stand on the shoulders of those that came before you. But in Houston compliance community we stand on each others shoulders and ohh I know you're waiting for this. Unless it get it over with, they'll come horns. Congratulations to both of you. Some people. I want to thank her here. It's gonna start with Dan Meyers. Dan picked me up off the scrap heap and I was a broken trial lawyer and hired me to work at Halliburton in contracts. And that's what started my compliance career, working for Dan at Halliburton. When I say stand on each others shoulders, I mean things like the following. Somehow or another, Jay and I were doing some project together and I can't even remember. I didn't work for Baker Hughes, never worked as a consultant for Baker Hughes. And one morning I get a text to you, an e-mail at 6:00 AM. Early 30 minutes later I got a text saying you haven't responded to my e-mail. 30 minutes after that I get up voicemail. On my e-mail you have responded. The way to a reasonable time in the morning and I call Vanessa Rossi and I say, Vanessa, I gotta text, excuse me, an e-mail, a text and a voicemail. And she said Tom, welcome to the team. Now that's a great story, but the point is, we were a team. We are a team in the Houston compliance community and we all work together. A second story is after I started my consulting practice, I had a $15 million software company client. They were too small to have their own sales force, so they outsourced all that. And I kept telling them, guys, if you don't do some due diligence and get these guys under contract, you're never going to get a contract in the energy space. And one piece of software that bolted on something down hold that did something. And so I finally convinced him to let me. But in a compliance program for a $15 million company. Well, two weeks later, I get a call from Doug Walter, says. Tom, we're taking a look at, you know, your company and I've been tasked with the looking at your compliance program. Can you send me what you did, your due diligence, how you did it, et cetera. So of course, I sent it all to it. But that's the kind of relationship we had with each other, that he could pick up the phone and call and say, Tom, I'm doing this, yeah, can you send me this? Had clearance to do it. We were all working together for compliance. And the reason we were working all together for compliance was? The energy industry was the first industry to go through an FCPA enforcement sweep in the first decade of this century. And everyone in this room either went through an enforcement action, went through a monitor ship, worked at a company now that has gone through it, or know somebody who went through what that has done is create the top compliance talent in the country. And Marianne Ibrahim, she gave a speech at once a week and I think 2013 and that forms half of a chapter of my compliance handbook on her thoughts. On how do you do a third party audit? That's the kind of talent we have in this city and continue to have in this city. And Dan, Dan Jack, first of all. In 2009, Parker Drilling was looking for a CI. And I wanted that job by entering for it. I was number two. Guess who was number 1. So I want to publicly thank you for getting that job. I got it. Who knows what would have happened, but I wouldn't have gone down the path I went on. But here's what Dan did at Partner Drilling. You may have heard of the currently called a Corporate Enforcement policy. It's the DOJ policy that rewards companies for engaging in extensive remediation and extensive cooperation. That was preceded by the FCPA corporate enforcement policy that was preceded by something called the Pilot program. All of that came from Dan Chapman. His work at Parker Drilling and convincing the Department of Justice. Yes, we had C-Suite level involvement in the bribery and corruption, but here's what we've done to remedy and here's how we've cooperated. And I've heard DOJ. Speakers talk about Dan Chapman and what he did at Parker Drilling. Just as Jay LED. To what was created for DPA and NPA's. Dan did that for corporations for discounts when they find themselves in trouble. So once again, that's the talent that we have in this city and I want to end with. Something that I didn't know until I read tonight's program. This comes to us from Joya Williams. Houston is one of the top leaders in number in the number and caliber of its compliance professionals and Gerber plays a crucial role in supporting our local community through education, professional development. The dedication of our members, officers, directors and sponsors in the field of business ethics is ongoing and Gerber remains committed to fostering. These efforts as we move to the next decade of ethics and compliance, I think that says we are standing on the shoulders of others. So I wanted to thank everyone in this room. BOOM - my 30 seconds of ✨FAME ✨. It is not often I get stopped in a parking lot to share insights via portable microphone about #culture and #compliance, but I loved it when it happened! ⭐️🎤🙋♀️
Ok, it didn’t happen exactly like that - perhaps in a parking lot, after lunch with the insightful and impromptu Ropes & Gray LLP’s Nitish Upadhyaya, and close to the SCCE compliance conference - BUT, I was 100% a “go” when asked. Top-of-mind thoughts on culture is one my favorite things to talk about because it is SO impactful to a organization.
People drive ALL organizations and it is often not those at the top - that said, the top often sets the tone for the organization that reverberates throughout. If you’re lucky enough to be in an organization that values people as much or more than profit, stay there. When leaders become blind to how much people mean to their business, culture reflects that - and not typically in a “good” way.
Valuing people is not soft, it is core to how business succeeds and the antithesis can result in painful departures, investigations, fines, and a poor reputation. A poor culture can devour an organization swiftly.
