Too often I hear people refer to Prenupital Agreements as “not worth the paper they’re written on.” However, it would also be a misconception to assume that a Prenup is automatically binding… So, is it worth spending the time and money to enter into a Prenup or not? Is it worth initiating what may be an awkward and difficult conversation before your special wedding day? The correct position is that Prenups can be given considerable weight by the court (and possibly upheld completely) if the correct procedure is followed and they are seen as fair. Whether a Prenup is fair will largely depend upon the circumstances upon the breakdown of the marriage. Are the current circumstances so different to what the circumstances were at signing? Does the Prenup meet the parties current needs? How long did the marriage last? The law surrounding Prenups can be a relatively complex, case heavy and not clear cut. It’s therefore vital for clients to seek specialist advice before entering such agreements. Individuals often worry about the reaction of their spouse-to-be when the topic of a Prenup is brought to the table. In family law proceedings, there are times when a Court is asked to make an order for one or both of the parties to receive a sum of money (referred to as partial property settlements) to fund the proceedings or to bring both parties on an equal footing, particularly when one party is earning a higher income or has the control over the assets. GETTING DIVORCED? IF YOUR EX ATTACKS YOUR LAWYER – THINK BACKWARDS. Often, a high-conflict husband will try to destroy his wife’s trust in her lawyer. The most common strategies are to claim that her attorney is incompetent, overly aggressive, or pumping up her legal fees. Conversely, the husband’s attorney - no matter how combative - is only defending the husband against the wife’s unethical counsel. It's a "Heads I win, Tails you lose" posture. To further create doubt, high-conflict husbands sometimes concoct and feed their wives outright lies. The husband might claim, “I’ve asked around and your lawyer is incompetent. He can’t win. You're going to lose on everything. You just don’t know it yet.” By driving a wedge between the attorney and client, the husband seeks to divide and conquer. Remove the wife's layer of protection for his own benefit. If your husband behaves this way, flip your perception around. Rule of thumb: If a husband attacks the wife's lawyer, he views that lawyer as a threat. On the other hand, if the wife's lawyer is helping the husband win, he'll tell his wife, "Your lawyer is the best in town. Great choice." This post does not constitute legal advice.
