Right here on Linkedin, you’ll find copycats stealing thought leaders’ posts and passing them off as their own genius. On Instagram, aggregator accounts can monetize off of other creators' content and share to millions of followers without credit. It’s practically pastime on Twitter/X at this point to steal someone else’s words and pass them off as one’s own — to a verified account, no less. And while, technically all of this is frowned upon, in many cases, it's not punishable. We decided to break down the Terms & Conditions into layperson's terms for the various platforms creators use to promote their work, and with this post, we're starting with Instagram's Terms of Use when it comes to content licensing. From their Terms of Use: “You hereby grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content.” What that means: In simple terms, when you post content on Instagram, you're giving them permission to use your content in various ways without paying you, and they can let others use it, too. So, what's the problem? Instagram is a free platform that also pays creators who get viral traction, after all. Well. Instagram is also a platform where an increasing number of aggregator profiles lift other users' content, often without consent or tagged credit. For some, this can be a follower boon. If an aggregator profile has a legitimate following (AKA not pumped up with thousands of bot followers) and they actually tag original creators in their posts, a jump in followers is almost guaranteed. For that to happen, though, the onus is on the aggregator to do the moral thing and tag the creator. It’s hard to even guesstimate how often that actually happens. On the money side, we have a bigger problem. As those aggregators rack up big followings and engagement numbers, they then get to make money off the content they share, even though they don't own it -- and the original creators don't get even a fraction of a cut of that monetization. Zip. Zero. And that, dear creator, is the problem. You have an idea, you put it out in the world as a video or an image or whathaveyou, and other people profit off of it, with or without credit to you. There is very little recourse for original creators who discover that their content has been ripped off without proper credit. This issue, among the many other mounting issues around digital content ownership and protection for creators, is why we’ve built TRACE.
