Kate Larsen makes some interesting observations and poses the question Are not for profit boards broken? I was reflecting on this with a particular focus on see in a rush to place more people with disability on the boards of organisations. As a board director myself, there is no doubt in my mind that leadership is at its best when it reflects the diversity of the communities it serves. Yet, people with disabilities remain significantly underrepresented on boards across all sectors. This is not just a missed opportunity—it’s a leadership gap. Disability leaders bring unparalleled lived experience, resilience, and innovation to the table. Leaders with disability challenge conventional thinking and provide insights that can transform organisations into truly inclusive spaces. Inclusion is not a “nice-to-have”; it’s a strategic advantage. Yet we see people with disability often overlooked and excluded. But a critical step I feel is being missed, before we focus on training people with disabilities to join boards, we must first address a critical question: Are our boardrooms culturally safe for disability leaders? Board culture must shift to ensure accessibility, psychological safety, and respect for diverse ways of working. Without this, efforts to recruit disability leaders will fail to be meaningful or sustainable. This raises an even broader challenge as Kate suggests: Are boards—particularly in the not-for-profit sector—fit for purpose? Many have argued that some not-for-profit boards are broken, operating within outdated models that fail to adapt to the complexity of modern governance. If boards continue to prioritise tradition over transformation, they risk excluding the very perspectives needed to solve today’s challenges, including those from disability leaders. To address these issues, we must: Proactively recruit disability leaders by addressing bias in board appointment processes. Change boardroom cultures to embed accessibility, inclusion, and equity at every level, ensuring leaders with disabilities feel valued and respected. Rethink governance models in the not-for-profit sector to ensure they are modern, adaptive, and truly representative of the communities they serve. Diversity doesn’t just check a box—it drives better decisions, enhances organisational performance, and reflects a commitment to equity and justice. When the FTC introduced a new rule banning non-compete clauses in employee agreements, non-profit entities asked, “Does this apply to us, too?” Non-profits generally fall outside the FTC’s jurisdiction that regulate corporations organized for profit. However, the non-compete ban is more nuanced. If a non-profit entity provides a “private benefit” that makes it a de facto profit-making enterprise, the new rule applies. This includes some hospital organizations or physician associations, and non-profits partnered with for-profits or that provide unreasonable compensation.
