VanDerStok, which will decide if the ATF overstepped its authority by issuing a Final Rule regulating ghost guns, firearms assembled from easily obtainable parts kits. The ATF's rule redefined "firearm" to include these kits and mandated background checks for their sale, in response to a significant increase in ghost gun-related crimes. Today’s decision by the United States Supreme Court, which confirms that it is lawful to restrict access to firearms for domestic violence perpetrators, is a significant relief to survivors and advocates. The immense danger posed to victims, their families, first responders, and the perpetrators themselves, when they possess guns, should not be controversial. There is overwhelming evidence of the lethal risk that exists when domestic abusers have access to guns. Let this decision serve as a call to action for our State to strengthen state laws on firearm access for domestic violence offenders. While Kansas law prohibits people who have been convicted of domestic violence or who are subject to DV protection orders from knowingly possessing firearms, Kansas law does not require the surrender of firearms, nor do the laws explicitly authorize the removal of firearms from the scene of a domestic violence incident by law enforcement. KCSDV applauds the Supreme Court’s decision to prioritize the safety of victims and survivors in this case. We now implore the State to do the same. At its Feb. 27 meeting, the Henrico Board of Supervisors will consider adoption of a revised version of an ordinance that would ban firearms from county-owned and county-operated facilities. The board previously opted to delay consideration of the proposed ordinance at its Dec. 12 meeting in order to allow staff members the chance to review comments received from the public. The revised proposal still would prohibit firearms, ammunition and components in all county buildings and those like the Henrico Sports and Events Center that are owned by the county but operated by another entity, but violation of the law now would result in a Class 2 misdemeanor in most cases, rather than a Class 1 misdemeanor as the initial proposal would have. (A Class 2 misdemeanor is punishable by a maximum of a $1,000 fine and six months in jail, whereas a Class 1 misdemeanor carries maximums of $2,500 in fines and one year in jail.) Nearly 25% of individuals who commit domestic violence-related murder-suicides are not legally barred from owning guns, and there is a concerning gap in gun control laws related to domestic violence.
