Interesting read across my feed today. "Airbnb also helps leaders craft messages and keeps hosts in the loop about coming legislative hearings through its platform. " This is a brilliant strategy, as it solves two issues. #1 - as the article stated if AirBnB walks into a room, they are immediately outsiders and labeled as part of the problem. But more importantly, #2 the resources (direction, content, and messaging) make it easy for hosts and PMs to communicate advocacy issues clearly with owners. Professional Hosts and Property Managers are not always trained in the tactics of lobbying and grass-roots campaigning, and this guidance is clearly invaluable and effective. Why? PMs and Professional hosts are not the local taxpayers - the owners are. Owners have much more power in a city town hall, especially if they come in numbers, than any out-of-state corporation may have, and they are likely the most financially affected by the decision of the local government. It is really easy to penalize nameless, faceless organizations or other businesses, but facing a room full of tax-paying owners that you are about to financially hurt is a tougher decision for sure. Big Airbnb and short-term let changes are imminent! 🏡 Owners of Airbnb and short-term let properties will have to get planning permission before renting out rooms in future under new rules. From this summer, the government will introduce legislation to require owners of new short-term lets in England to secure planning permission to use their properties for short-term rentals. This should allow councils to control the number of licences issued in a particular area, with a mandatory national register also be set up to detail all short-term lets. It is likely that HMRC and other enforcement agencies would have access to the register. When you want to learn about short-term rentals/Airbnb, make sure you are speaking with an ACTUAL expert. I've spoken to many amateurs, realtors, and "gurus" who just don't know what good revenue looks like, how to pick a market, etc. I once attended a webinar where they brought someone on to teach a bunch of newbies about Airbnb and when a guest asked him the question about how to file claims against a guest, he didn't know anything about the subject because he claimed he's never had to do it and doesn't know anyone who has ever had to do it either. Red flag anyone? I collect a security deposit because I have to file claims against guests so frequently and Airbnb rarely reimburses the host for damages, regardless of the amount of proof presented. Again, please speak with an expert. You wouldn't trust a lawyer with important medical decisions, so why trust someone who has never managed an Airbnb to manage your investment? #ShortTermRentals #AirbnbTips #HospitalityIndustry #PropertyManagement #ExpertAdvice

My new article, ‘Exclusive Possession, “Contractualisation” and the Lease-Licence Dichotomy: A Reconsideration of Legal Categorisation in the Airbnb Era’, has just been published in the Adelaide Law Review. This article examines the issue of legal categorisation vis-à-vis the relationship between the Airbnb host and the Airbnb guest. Focusing on the common law distinction between leases and licences, this article re-evaluates the analysis of the lease-licence dichotomy in the context of Airbnb. It argues that the elements of possession — physical control (factum possessionis) and relevant intention (animus possidendi) — should be considered in the lease-license analysis. With this normative claim, this article concludes that contrary to the decision in Swan v Uecker, the contractual arrangement between the Airbnb host and the Airbnb guest should be categorised as a licence relationship, rather than a lease.
