Draft legislation is emerging within the European Union relating to sustainable textile production and labelling. Textile legislation in the EU will have a significant impact on the largest consumer market for textiles in the world. It is being closely followed in other regions; many countries are likely to follow the EU in introducing legislation intended to improve the sustainability of the textile value chain. EU draft legislation will require a life-cycle assessment of each item, using a complex system of Product Environmental Footprint Category Rules (PEF CR). The impact of these rules will fall first on textile producers, who will be responsible for capturing the evidence against the PEFCR. As currently constructed, these rules ignore important factors, such as microplastics and plastic waste; nor do they recognize the full environmental impact of fossil-fuel fibers; nor recognize the positive impact of natural fibers, like cotton, that are renewable, recyclable, and biodegradable. If left unchanged, the outcome will be that, under the PEF framework, man-made fibers will be assessed as being more sustainable than natural ones. https://lnkd.in/dRRK5T_M

California continues to raise the sails as a flagship for EPR policy in the US. First with its foundational SB 54 law placing the liability on producers for managing packaging lifecycles, and now again for textiles/apparel. While plastics and paper have existing circular infrastructure to expand on, the same cannot be said for textile waste, which makes this law so impactful. This is a big step towards reducing carbon emissions, permeation of PFAs and microplastics, and accumulation in landfills. The motivation for circular design in products is growing! Not just to address fees imposed by EPR policy, but to secure stability and cost efficiency within the supply chain. Today, I watched the recording of Chairman Senator Carper leading the Extended Producer Responsibility hearing in the Senate Committee on Environment and Public Works. Senator Capito of West Virginia, Senator Ricketts of Nebraska, and Senator Padilla of California joined him at various points. These senators posed insightful questions on the benefits, challenges, and realities of Extended Producer Responsibility policies to H Fisk Johnson the namesake and CEO of Sc. Johnson; Erin Simon of the World Wildlife Fund, who brings a decade of packaging engineering experience; and Dan Felton the executive director of the American Institute for Packaging and the Environment. Here, I summarize the key themes discussed for my reference and those seeking a concise overview. Federal Oversight vs. State Oversight: Arguments for federal oversight claim it is necessary to preclude inconsistencies in state-specific regulations, which could lead to over-regulation and hinder business operations across state lines. There is a strong call for harmonization of standards to ensure that materials design and recycling processes are aligned nationally, reducing the complexity and cost of compliance for producers. Rural Marginalization: Senators Capito and Ricketts both emphasized the possibility of marginalizing rural groups as an unintended consequence of these policies. Costs to Consumer: The economic implications of EPR are debated, emphasizing the potential for increased consumer costs and the impact on product pricing. Panelists suggest that federal standards mitigate these issues more effectively than disparate state laws and that packaging costs are already on the consumer. Eco-modulation: This strategy aims to incentivize environmentally friendly materials and discourage the use of less sustainable ones through a hierarchy of plastic products. The approach could reshape how we produce and consume plastics and create an entire economy in itself. Reuse & Refill: Using reuse and refill stations as a broader strategy to reduce plastic consumption. Mr. Johnson mentions success in France but stresses that the American consumer is unprepared and doesn’t consider plastic impact. Emphasizes the need for further education and incentivization. Lastly, Sen. Carper and panelists emphasized the importance of consensus among various stakeholders. Mr. Felton stressed the need for comprehensive data to guide EPR policies and help craft effective packaging regulations.

Take note. California #SB343 will change the markings that are allowable on #plasticpackaging. #ChasingArrows is associated with #recyclable and the #legislation requires proof of #recyclablilty. CalRecycle recently published a #MaterialCharacterization study indicating that these plastic items may not qualify as recyclable in California: deodorant containers, plastic takeout food containers and lids, squeezable drink bottles, plastic wine bladders, plastic plates and trays, plastic drinking cups, trash bags, plastic merchandise bags, baby and cleaning wipe packages and plastic bread bags. The regulation's restrictions will likely take effect late in 2025 or early in 2026. Now is the time to move from the old chasing arrows resin identification code (RIC) to the new triangle #RIC, which has been the official RIC for decades now. What are your thoughts?
