A new Milbank Memorial Fund report shows more nurse practitioners (NPs) and physician associates (PAs) are moving into specialty care. From 2008 to 2016, specialty practices employing NPs and PAs grew by 22%. In 2022, NY passed legislation granting full practice authority to NPs. And the results have been overwhelmingly positive. Nurse practitioners are happy to see their skills being applied in rich and meaningful ways, and doctors are happy for relief from the pressures of relentless demand. Healthcare providers can now see more patients, with shorter wait times for an appointment. This increases patient satisfaction and improves outcomes through faster diagnosis and treatment. Pennsylvania is losing nurse practitioners to neighboring states that already offer NPs full practice authority. These NPs are leaving to do the job that they've been trained and educated to do, without the unnecessary restrictions placed on their ability to practice and care for patients. Studies show that full practice authority laws increase the number of NPs who remain and work in the state after graduation. And once practicing, NPs are more likely to move to a state with full practice authority, rather than the reverse. This means Pennsylvania likely won't gain back NPs who have moved to other states – unless PA enacts full practice authority legislation. In the midst of severe healthcare workforce shortages, Pennsylvania should be taking action to become a desirable place for NPs and other skilled healthcare professionals to work, rather than restricting their ability to practice. Full practice authority can help retain our valuable NP workforce, gain back NPs who left due to restrictive laws, and attract talented NPs from other states. And a greater number of NPs means greater healthcare options and access for patients across Pennsylvania. Locum tenens is a Latin phrase that means “(one) holding a place.” In the medical field, locum tenens are contracted physicians who substitute for a physician who has left the practice, or who is temporarily unavailable (For example on medical leave, on vacation). The Centers for Medicare & Medicaid Services (CMS) allows payment for services provided by locum tenens physicians. The locum tenens provision is widely used, but often misunderstood, which puts practices at risk if the guidelines are not followed. A big concern has been incorrect or misunderstood advice from companies placing locum tenens. Many are reputable companies that clearly understand CMS rules, but others may mislead offices to think they can keep these temps long term, or use nurse practitioners as locum tenens. Section 1842(b) (6) (D) of the Social Security Act clarifies that this is a “physician for physician services” provision. In other words, services provided by non-physician practitioners (e.g., nurse practitioners and physician assistants) may not be billed under the locum tenens provision.
