The answer is YES! However... you can't be more at fault than the other driver, and the amount of money you can recover is decreased by the percentage you were at fault. For example: if you were 35% at fault for the car wreck, you may be still be able to receive 65% of your incurred damages. Here's the catch... it's the insurance company who will be the first to suggest that you were partially liable for the crash, especially if the police report is not very clear or there is a lack of evidence to corroborate your recollection of the car crash.
