Celebrating 1000+ LinkedIn followers with another Building Safety Act 2022 ("BSA") musing! 🌟 An interesting article below on the impact of the BSA on hotels. Whilst Regulation 8(2) of the Higher-Risk Buildings (Descriptions and Supplementary Provisions) Regulations 2023 excludes hotels from being a 'higher risk building' ("HRB") under the BSA, this only applies to stand alone hotels. Where there are mixed developments including hotels, residential and other commercial premises and they are 7+ storeys high/18m or more then hotels will fall under the BSA regime and the HRB obligations will apply. Although it wouldn't be the BSA without another exception that hotels will not apply, even in mixed developments, if they are situated in an “independent section” of that building. New safety requirement alert! Effective August 1, 2024, all hotels, lodges, and motels in the State of Minnesota must have carbon monoxide alarms in every guest room. This law is not limited to new construction; the statute is retroactive, meaning that all owners of existing motels, hotels, and lodges are required to install CO alarms in rooms that were previously without them in order to stay compliant. I wrote a piece in today's New York Daily News about a bill before the NY City Council that would require hotels to directly employ housekeepers & front desk staff, instead of subcontracting for these functions. Here's the piece: https://lnkd.in/eA7x_kyF Some hotels currently subcontract for these core jobs, an example of what Brandeis Professor David Weil has called the #FissuredWorkplace: businesses use models (like subcontracting or staffing agencies) that allow them to avoid employer responsibilities. It leads to higher rates of violations and lower wages & benefits. Several jurisdictions have passed laws in recent years to try to mitigate the harm of fissuring: a number of states have laws that create construction general contractor liability for wage violations by subcontractors (deterring violations by incentivizing greater due diligence and monitoring), and NJ and IL both passed laws requiring wage parity for temp workers and permanent employees at the worksites where they're placed, thereby lowering the economic incentives for fissuring. The NYC bill, if it passes, would be another good example of policy to push back against the fissured workplace.
